The committee relegated Surreal Moment from second to third placing.

Facts:

At the conclusion of Race 5 the Pegasus Spur at Woodlands Stub Provincial Drivers Handicap Trot a protest was lodged by Stipendiary Steward Mr C.J Allison alleging that Surreal Moment (M. Williamson) broke over the final stages, being lapped on by Galaxy Hunter (Z. Butcher).

Mr G. Lee the Trainer of Surreal Moment did not contest the protest.

The Rule reads:

"Notwithstanding the provisions of sub-rule (4) hereof any horse which is not in the correct gait when its nose reaches the finishing line and which is lapped on by any other horse or horses in the correct gait shall be placed by the Judicial Committee behind such horse or horses provided that where such first mentioned horse is not in its correct gait as a result of interference to such horse or its horseman, then (subject to Rule 869(8)) such relegation of the horse shall be at the discretion of the Judicial Committee".

Submissions for Decision:

Stipendiary Steward Mr C. Allison stated that Surreal Moment had broken just short of the winning post, and the lapped on rule applied.

Mr Lee has accepted the evidence of the Stewards and did not wish to appear at the hearing. Mr Allison showed the committee the video clips of the alleged incident.

Reasons for Decision:

The committee was satisfied a clear breach of the lapped on rule had occurred, and as a result find the charge proved, and uphold the protest.
