The protest was upheld and JUMPFORJOY was relegated to last placing. Amended placings were confirmed as follows:

1st Scarrymcleary (No 1)
2nd Hitthegroundrunning (No 2)
3rd No Courage Russell (No 7)
4th Flying Diamonds (No 9)
5th Von Regal (No 5)

In accordance with its decision the committee authorised payment of dividends.

Facts:

This is an uncontested protest hearing instigated by the Stipendiary Stewards following the running of Race 9. The grounds for the protest are that horse number 6, JUMPFORJOY, broke in excess of 150m at the start, being in breach of Rule 870 (3) and Breaking horse regulations. Mr Barron was twice offered the opportunity to sign the Information and to attend the hearing, he declined both offers.

The Provisional placings were:

2nd Jumpforjoy (No 6)
3rd Hitthegroundrunning (No 2)
4th No Courage Russell (No 7)
5th Flying Diamonds (No 9)
6th Von Regal (No 5)

Submissions for Decision:

Mr Wallis demonstrated the incident using the available video film. He told the committee that JUMPFORJOY had broken at the start and had continued in a break until appro. 10m past the 150m marker. Mr Wallis stated that this constituted a break of some 170m. This was clearly evident on the video film.

Reasons for Decision:

The protest is not contested and the evidence is clear that JUMPFORJOY galloped in excess of 150m. The provisions of Rule 870 (3) and Breaking Horses Regulations apply.
