DECISION, REASON & PENALTY

Information 65180 alleges that Mr A K Black, Junior Horseman, driver of CUT AND STYLE, drove carelessly with approximately 500 metres to run when moving inwards onto ODIN?S SON driven by B G Morris, causing ODIN?S SON to break, checking ANTHONY SHAUN, with both horses losing their chances.

Mr Black and Mr Knowles agreed that all evidence that was given in the (separate) Information 13323 was relevant and that, due to Mr Black's guilty plea, submissions on fixing penalty only were required to be heard.

Stipendiary Steward Mr Knowles stated that Mr Black was a Junior Horseman who was driving up to seven horses per raceday. Mr Black had received on previous penalty under this Rule, eleven months ago, which resulted in a suspension and fine.

Mr Knowles also stated that the level of carelessness was, in his opinion, middle of the range, however did affect the chances of two horses, resulting in a horse driven by Mr Black in a dividend-bearing place being relegated.

Mr Black stated that he had commitments to Junior Drivers races in the next couple of weeks.

Mr Knowles then stated that there was a genuine lack of Junior Drivers in the region and that under these circumstances he believed a fine may be deemed appropriate.

In fixing penalty, Mr Black was fined the sum of $300.00. Consideration was given to his good driving record over the past three months, the number of raceday drives and his guilty please.
