Stipendiary Steward, Mr PT Knowles, alleged that Mr AS Malcolmson (FRANCO SOLITAIRE) failed to keep clear of the passing lane and was in breach of Regulations 4 and 7 of the Passing Lane Regulations.
| -- DECISION AND REASONS: --Stipendiary Steward, Mr PT Knowles, alleged that Mr AS Malcolmson (FRANCO SOLITAIRE) failed to keep clear of the passing lane and was in breach of Regulations 4 and 7 of the Passing Lane Regulations. --It was agreed that evidence from the protest held earlier be taken as read. As Mr Malcolmson has admitted the charge under Rule 1111(1)(a) I find the charge proven. --Mr Malcolmson said the horse would not come out of the passing lane despite his urgings. He said he did not want to be there and he would have won the race if it kept straight. --Mr Knowles felt Mr Malcolmson could have done much more to get FRANCO SOLITAIRE out of the lane. He pointed out he did not stop driving the horse out. He asked for a fine. --After hearing the evidence, I take into account Mr Malcolmson's clear record over the past 12 months, his early admission of the charge and fine him $200. --CHAIRMAN |
