Stipendiary Steward, Mr PT Knowles, alleged that "In the home straight FRANCO SOLITAIRE (AS Malcolmson) while leading into the straight failed to keep the passing lane clear for trailing runners."
| -- DECISION AND REASONS: --Stipendiary Steward, Mr PT Knowles, alleged that "In the home straight FRANCO SOLITAIRE (AS Malcolmson) while leading into the straight failed to keep the passing lane clear for trailing runners." --Video evidence was shown which clearly showed FRANCO SOLITAIRE in the passing lane and this then forced Mr BD McLellan to push his way outwards from the trail past JUNIOR ANVIL (LJ Bond) and OK CONTACT (RM Tither). --Mr Malcolmson said he had kicked clear and the horse hung out into the passing lane and despite his efforts could not be moved out of it and he did not feel he had hindered IT?S ELLA's progress. --Mr McLellan said he was on Mr Malcolmson's back and as the passing lane was occupied by FRANCO SOLITAIRE he had to push through a three-quarter gap outside FRANCO SOLITAIRE which he described as "a bit tight". --Mr Malcolmson then asked him "would you have beaten my horse?" Mr McLellan replied, "I was going very well and had not pulled the ear plugs." --Based on the evidence heard, and the video evidence which was very clear, I uphold the protest as I find that FRANCO SOLITAIRE gained sufficient advantage from his use of the passing lane to have effected IT?S ELLA enough to have effected the order of finishing. --No.12, FRANCO SOLITAIRE was relegated to third, and No.15, IT?S ELLA was promoted to second. --Judge's Placings: 4 ? 12 ?15 ? 2 ? 3 ? 5 --Amended Placings: 4 ? 15 ? 12 ?2 ? 3 ? 5 --CHAIRMAN |
