Mr Milne admitted the breach, which we thus find proved.

Penalty:

We impose a fine of $150.

Charge:

Mr Allison, stipendiary steward, alleged that Mr A D Milne (WAZZA PLAYER) used his whip excessively over the final stages.

Facts:

Mr Allison used video film to demonstrate where the respondent used his whip some 25 times from just before the straight entrance to the finishing post. The horse was placed third.

Submissions for Decision:

Mr Allison acknowledged that the respondent had broken up the strikes, but that there were just too many of them.

Mr Milne admitted that the number was correct, but asked the committee to consider that he was attempting to break up the strikes, that he felt that the horse was responding well to encouragement. Finally Mr Milne produced his whip which he maintained was well worn and soft.

Submissions for Penalty:

Mr Allison stated that Mr Milne had a clear record under this rule. He submitted that the breach was at the lower end of the scale.

Reasons for Penalty:

The Committee decided that the breach was at the lower end. The respondent had clearly attempted to break up the strikes, attempting to comply with the rule.

The Penalty Guide recommends a starting point of 6 drives or $300. The committee took into account Mr Milne’s excellent driving record, the stake for the race ($165 for third placing), Mr Milne’s early admission and Mr Allison’s comments regarding the seriousness of the offence.
