Decision: Driver, Mr BG Barclay, was charged with a breach of Rule 869(3)(b) - Careless Driving.

Decision and Reason:

--

In that with approximately 1900m to run, Casementi (B.G. Barclay) moved inwards onto Wing And A Prayer (K.L. Green) checking that runner causing it to lose its chance.

Mr Allison used video clips to highlight the alleged incidents and evidence was heard from both Mr Barclay (Casement) and Miss K.L green (Wing and a Prayer).

Mr Barclay admitted to causing the tightening to Miss Green who was attempting to improve along the rails to the trailing position. Mr Barclay maintained that he felt that his horse had not made contact with (Wing and a Prayer) Miss Green.

Miss Green giving evidence maintained that Casementi (Mr Barclay) did indeed make contact (Although slight) and caused her horse to break.

After hearing all evidence and studying the race video, the committee decided that Casementi (Mr Barclay) did indeed move sharply inwards on Wing and a Prayer (Miss K. Green) causing it to break and lose any chance.

In his summary, Mr Allison, Stipendary Steward did point out that Mr Barclay had a perfect driving record and indeed is one of the safest drivers in the south ? and than Mr Barclay did attempt to straighten his horse (Albeit too late).

--

The committee found the charge proven and in fixing penalty was mindful of Mr Barclay's recent driving record and also considered the interference to be of a minor nature (at the lower end of the scale).

--

Mr Barclay was fined $250.00.
