Ms Ottley admitted the charge and it is found proved.

Facts:

Mr Renault lodged an information alleging a breach of rule 896(4)(6)(b)(c) in that Ms Ottley permitted her horse SPIRIT OF DELIGHT to shift outwards near the 1500 metre mark resulting in ESPECIAL (M Anderson) being forced wider on the track in the Join The Tricode Syndicates Fillies and Mares Mobile Pace.

Rule 869 (4)(6)(b)(c) reads.

(4) No horseman shall during any race do anything which interferes or is likely to interfere with his own horse and/or any other horse or its progress.

(6) “Subject to sub-rule (4) hereof:-

(b) a horse making a forward moment during any race shall not be forced to race wider on the track;

(c) a horse during a race shall not move ground outwards once the nose of the wider runner coming forward is in line with or past its sulky wheel and until the wider runner going forward is fully past.”

Ms Ottley admitted the breach and did not attend the hearing.

With the use of the video replays Mr Renault stated that Ms Ottley had drawn 2, where from the mobile gate she took the lead and was then headed, taking up a trailing position. About the 1500 metre mark Ms Ottley has pushed off the trailing position to take the lead. To her outside was ESPECIAL (M Anderson) in the parked position and three wide was IDEAL CONQUEST (B Barclay). ESPECIAL was covering the wheel of SPIRIT OF DELIGHT (S Ottley) when she pushed out. This manoeuvre has resulted in M Anderson having to move wider on the track, which in so has forced Mr Barclay wider as well. Both ESPECIAL and IDEAL CONQUEST were moving forward of Ms Ottley’s wheel when she move out.

Mr Renault stated Ms Ottley has simply made a misjudgement. Also there was no protest as a result of this incident as both horses forced wider finished ahead of Ms Ottley.

Submissions for Penalty:

Mr Renault stated Ms Ottley is a very busy driver with 473 drives this season to date and 410 drives in the last season, with a good record under this rule with no breaches in the past 12 months.

The Stewards believed a fine around the vicinity of $200 was appropriate due to Ms Ottley’s record and admission.

Ms Ottley through Mr Renault asked to be brought to the Committee's attention that she had flown down to Invercargill at her cost and was out of pocket with this charge and wanted that said for our attention.

Reasons for Penalty:

Under the JCA Penalty Guide we have a starting point of $250. There are no aggravating factors but in Ms Ottley’s favour are her good record and her admission for which we give a modest discount.
