As Mr Vince admitted the breach we find the charge proved.

Facts:
Following the running of race 1, the FAIRVIEW MOTORS CAMBRIDGE AMATEUR DRIVERS MOBILE PACE, an Information was laid by Mr Mulcay alleging that Amateur Horseman Mr T Vince drove MACH CULLEN carelessly, striking the wheel of the sulky of LAMBRUSCO with 600 metres to run.
Mr Vince endorsed the Information to the effect that he admitted the breach and that he did not wish to attend the hearing.
Rule 869(3)(b) states ' No horseman in any race shall drive carelessly'.
Using the available video films, Mr Mulcay identified the horse MACH CULLEN driven by Mr Vince. At a position in the back straight with about 600 metres to run MACH CULLEN was 3 back on the outer with LAMBRUSCO ahead of it. Mr Vince began to improve MACH CULLEN, and as it passed LAMBRUSCO it was clear that MACH CULLEN brushed the off-side wheel of LAMBRUSCO'S sulky. This caused the tyre to puncture and the tyre and tube became separated from the wheel rim. As a result LAMBRUSCO was disadvantaged and its' chances of finishing in a place were virtually extinguished.
Submissions for Penalty:
Mr Mulcay produced Mr Vince's driving record which showed he had no prior breaches of this Rule. He added that the Stewards felt the breach was at the low end of the scale, and together with Mr Vince's admission submitted that a fine in the vicinity of $200 would be appropriate.
Reasons for Penalty:
The Committee took into account the Stewards' submissions on penalty. We adopted the JCA Penalty Guide starting point of a suspension of 8 days or a $400 fine. We accept that the breach was at the lower end of the scale, to his credit Mr Vince has admitted the breach and he has a clear record under this Rule. However as a result of his driving it is a fact that LAMBRUSCO had its chances extinguished.
