The Protest is upheld and the horse PIPPA MIDDLETON is disqualifed from the race.
The placings therefore are:
1st - SUNOVA

Facts:
Following the running of Race 1, the TONY COOK GROUNDSPREADERS/BOWERS & SON TROT an Information was filed by Stipendiary Steward, Mr J Muirhead instigating a protest against the 4th placed horse PIPPA MIDDLETON. The Stewards alleged that the horse broke in excess of 50 metres inside the final 200 metres.
Mr McGowan, the driver of PIPPA MIDDLETON and appearing for the horses connections endorsed the Information to the effect that he did not contest the protest.
The Judges placings were :
1st - SUNOVA
2nd - SPRINGFIELD HUGH
3rd - A NIGHT IN PARIS
4th - PIPPA MIDDLETON
5th - THANKS SHANE
Rule 870 (3) states ' Any horse which breaks from its gait shall promptly regain its proper gait'
The Breaking Horse Regulations provide ' Any horse which breaks from its gait within the final 200 metres of any race and continues on in the break for a distance of 50 metres or greater, shall be deemed to be in breach of Rule 870 (3) in that it has failed to promptly regain its gait.
Where a protest has been duly lodged against the placing of an offending horse , the Judicial Committee shall either-
(a) relegate such horse under Rule 870 (4) to behind any horse in respect of which an advantage may have been gained, or
(b) disqualify it from the race under Rule 1003 (2).
Submissions for Decision:
Mr Muirhead used the availaible films to demonstrate that the horse PIPPA MIDDLETON had gone off stride in the final straight and continued in a a gallop for approximately 70 metres. The horse had galloped just prior to the 100 metre marker and continued to gallop until past the 50 metre marker.
Mr Muirhead asked the Committee to disqualify the horse from the race in accordance with Rule 1003 (2).
Reasons for Decision:
As this was an uncontested protest the Commiteee upheld it.
