Facts:
Following the running of the DUNSTAN FEEDS HEADS JEWELLS MOBILE TROT an Information instigating a Protest was lodged by Stipendiary Steward Mr JM Muirhead against the 1st placing of REINE DES GITANS on the grounds that that horse broke short of the winning post in the run home and was "lapped on" by LE LUA INVASION (placed 2nd) and HOT CHOCOLATE TART (placed 3rd).
Rule 870(5) is the "lapped on" rule which applies when a horse is in a break when its nose reaches the finishing line.
Mr Z Butcher the driver of REINE DES GITANS endorsed the Information with the words "I do not contest the Protest".
Mr Muirhead demonstrated the incident by use of the race films and showed where REINE DES GITANS broke about 40 metres from the finishing line and was in a break at the winning post. It was lapped on by the 2nd and 3rd horses.

Mr Muirhead submitted that because REINE DES GITANS was lapped on by both LE LUA INVASION and HOT CHOCOLATE TART it should be relegated behind those 2 horses.
