The Committee imposes a Fine of $200.00 on Mr Judson.

Facts:

Following the running of the CAMBRIDGE TAB AMATEUR DRIVERS MOBILE PACE an Information was lodged by Stipendiary Steward Mr JM Muirhead against Amateur Horseman Mr K Judson alleging that Mr Judson used his whip in an excessive manner when driving HOWZAT in the run home.

Mr Judson admitted the breach and did not wish to be present at the Hearing.

Mr Muirhead demonstrated the incident by use of the Race Films and he showed that from about the 300 metres mark Mr Judson had used the whip 21 times. He said that pursuant to the Whip Guidelines and also in the Steward's view that was excessive.

Submissions for Decision:

Mr Muirhead said that the use of the whip 21 times was excessive.

Reasons for Decision:

The Charge is admitted.

Submissions for Penalty:

Mr Muirhead said that the JCA Guidelines provide for a starting point Penalty of a Fine of $300.00 or a suspension of Licence for 6 Drives.

He did say however that Mr Judson had admitted the breach and that he had a good record. He submitted that as this was Mr Judson's first breach of this Rule that a Fine of $200.00 was appropriate.

Reasons for Penalty:

The Committee viewed the Films and they clearly show Mr Judson's use of the whip which is certainly excessive. He has admitted the breach and does have a good record and we take those factors into account when assessing Penalty.

We have checked previous Penalties for this Offence and taking all matters into account we believe that the Penalty submitted by Mr Muirhead is appropriate.
