The Protest is upheld. The Committee is aware that it has a discretion under this rule but to be consistent with previous decisions we believe disqualification is appropriate.

ARDEN'S CHOICE is therefore disqualified from the race.

The amended placing are now : first     (6) PICCADILLY PRINCESS

                                                 second (3) ECLIPSE ME

                                                 third     (5) BETTOR THINK QUICK

                                                 fourth   (1) ARE YOU READY GIRL

It is ordered that dividends and stakes are paid in accordance with the amended placings.

Facts:

Following the running of the NEVELE R FILLIES SERIES (HEAT 5) MOBILE PACE an Information instigating a Protest was lodged by Stipendiary Steward Mr S Mulcay against the 4th placing of ARDEN'S CHOICE on the grounds that it broke from its gait approximately 75 metres from the finish and failed to regain its gait promptly in the run home.

Mr S Grayling on behalf of the Trainer Mr B Purdon endorsed the Information with the words " Protest not contested ".

Rule 870(3) requires "any horse which breaks from its gait during a race to regain its gait promptly."

The Breaking Horses Regulations state "that any horse which breaks during the last 200 metres of a race and remains in a break for 50 metres or more shall be in breach of Rule 870(3)."

Mr Mulcay demonstrated the incident by use of the race films and showed ARDEN'S CHOICE going into a break approximately 75 metres from the finish and continuing in a break until the finishing post.

Submissions for Decision:

Mr Mulcay said that ARDEN'S CHOICE was in breach of Rule 870(3). In respect to the Rule he did point out that the Committee had a discretion to relegate the horse rather than disqualify it from the race.
