The protest is upheld and the horse TEMBI is disqualified from its 4th placing.

The official placings are now:

1st - Sir Richie

2nd - Imajollywally

3rd - hardon's Pearl

4th - Shards Phoenix

Authority was given for the payments of dividends and stakemoney in accordance with the amended placings.

Facts:

Following the running of Race 3, the MICO HAMILTON MOBILE PACE, an Information instigating a protest was lodged by Mr Muirhead, alleging that the horse TEMBI had broken in excess of 50m over the final 200 metres.

The Judges placings as the horses crossed the finish were:

1st - Sir Richie

2nd -Imajollywally

3rd - Shardon's Pearl

4th - Tembi

5th - Shards Phoenix

Mr Dickie elected not to appear at the hearing. He endorsed the Information to the effect that he did not contest the protest.

Rule 870(3) provides that ' Any horse which breaks from its gait shall promptly regain its proper gait'.

The Breaking Horses Regulations provide that ' Any horse which breaks from its gait within the final 200 metres of any race and continues on in the break for a distance of 50 metres or greater, shall be deemed to be in breach of Rule 870(3) in that it has failed to promptly regain its proper gait'.

Submissions for Decision:

Using the available films Mr Muirhead identified the horse TEMBI as it passed the 70m mark. The horse went off stride and galloped to the finish of the race. TEMBI was in 4th position as it passed the finishing post.

Mr Muirhead accordingly submitted that the horse TEMBI should be disqualified from its 4th placing.

Reasons for Decision:

As Mr Dickie has endorsed the Information to the effect that he did not contest the protest we accordingly uphold it.
