Decision: Following the running of Race 6, the Mountain River Processors Handicap Trot, an Information Instigating a Protest was laid by Stipendiary Steward Mrs K. R. Williams alleging a breach of Rule 870(3) and the “Breaking Horses” Regulation by MON STAR (13)

Following the running of Race 6, the Mountain River Processors Handicap Trot, an Information Instigating a Protest was laid by Stipendiary Steward Mrs K. R. Williams alleging a breach of Rule 870(3) and the “Breaking Horses” Regulation by MON STAR (13) which finished 5th (later promoted to 4th) in the race.

--

--

The relevant “Breaking Horse” Regulation provides that any horse which

--

breaks from its gait either at the start or during the running of any race, and continues on in the break for a distance of 150 metres or greater, shall be deemed to be in breach of Rule 870(3) in that it failed to promptly regain its proper gait.

--

--

The driver of MON STAR, Mr S. Dickson, had endorsed the information “I do not contest the protest”.  Video coverage showed that MON STAR had broken at the start of the race and was in a break for about 180 metres.

--

--

Therefore in accordance with Rule 870(3) and the “Breaking Horses” Regulation MON STAR was disqualified from fourth placing.
