As Ms Williams admitted the breach the Committee found the charge proved.
Penalty:
Accordingly, Ms Williams had her license to ride in races suspended for a period to commence after racing on 26 March and conclude after racing on 4 April 2018.
Facts:
Following the running of race 6, Yaldhurst Woods & NZWTA Ltd Rating 65, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Williamson, alleged that Ms K Williams allowed her mount STONEMASON to shift ground outwards at the 400 metres when not clear of PASSAMAQUODDY (C Campbell) which was checked.
Ms Williams acknowledged that she understood the Rule and confirmed her admission of the breach.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr McLaughlin using the video films identified the horses involved in the incident. He showed that Ms Williams shifted ground at the 400 metres when only a bare length clear of PASSAMAQUODDY. He said as a consequence that runner lost its rightful line of running.
Ms Williams said that her mount was not going forward and she was bewildered that the interference happened. She said that she didn’t realise that PASSAMAQUODDY was racing directly behind her and the incident was an error of judgement on her part.
Submissions for Penalty:
Mr Williamson produced Ms Williams’ record which showed 1 previous breach under this Rule in the last 12 months. He said there was no intent in the incident and added that it was an error of judgement on Ms Williams’ part. He submitted a low end suspension would be appropriate.
Ms Williams advised that she had engagements at Wingatui on 26 March and any proposed suspension could start after that date.
Reasons for Penalty:
The Committee carefully considered all the evidence and submissions presented.
When reviewing the video films it was evident to the Committee that Ms Williams angled her mount outwards near the 400 metres when not sufficiently clear of PASSAMAQUODDY which was checked. The level of carelessness displayed by Ms Williams was low range.
The JCA Penalty Guide starting point for low range carelessness is 6 days and that was adopted.
There were no aggravating factors.
The mitigating factors were Ms Williams’ admission of the breach and her very good record. For these combined factors Ms Williams was afforded a 1 day reduction.
After taking into account all the above factors the Committee considered an appropriate suspension was 5 national riding days.
