As Mrs Allpress admitted the breach the Committee found the charge proved.

Penalty:

The Committee grants a 7 day deferment to Mrs Allpress’ suspension pursuant to Rule 1106(2).

Accordingly, Mrs Allpress had her license to ride in races suspended for a period to commence after racing on 31 March and conclude after racing on 6 April 2018.

Facts:

Following the running of race 5, R Redpath Ltd Rating 75, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Williamson, alleged that Mrs Allpress permitted her mount TAXIHOME to shift outwards near the 300 metres when not clear of ABLAZE (J Lowry).

Mrs Allpress acknowledged that she understood the Rule and confirmed her admission of the breach.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr McLaughlin using the video films identified the horses involved in the incident. He showed that Mrs Allpress shifted ground near the 300 metres when only a bare length clear of ABLAZE. He said this resulted in Mr Lowry having to steady his mount when hampered.

Mrs Allpress acknowledged that she shifted out near the 300 metres but in explanation stated she didn’t realise that Mr Lowry was racing behind her. She said that today was her 2nd day back race riding after an injury and described the incident as misjudgement on her part.

Submissions for Penalty:

Mr Williamson produced Mrs Allpress’ record which showed no previous breaches under this Rule in the last 12 months. He said this was an excellent record for such a busy rider and the check suffered by ABLAZE was a “small one”. He said to Mrs Allpress' credit she admitted the breach and the interference was low end. He submitted the breach warranted a suspension of less than 5 days.

Mrs Allpress advised that she had firm engagements at Palmerston North on 31 March and any proposed suspension could start after that date.

In response to a question from the Committee, Mrs Allpress confirmed that she had been away from race riding for 5 months due to a shoulder injury.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented.

When reviewing the video films it was evident to the Committee that the outward shift by Mrs Allpress was very minor and the impact on ABLAZE was minimal. The carelessness displayed by Mrs Allpress was low range.

The JCA Penalty Guide starting point for low range carelessness is 6 days and that was adopted.

There were no aggravating factors.

The mitigating factors were Mrs Allpress’ admission of the breach and we note her last breach of this Rule was 11 May 2016, which is an outstanding record for a busy rider. For these combined factors Mrs Allpress was afforded a rare 2 day reduction.

After taking into account all the above factors the Committee considered an appropriate suspension was 4 national riding days.
