Following the running of Race 1, Mr P J Williams, the trainer of the 3rd place horse "AL FAROUK" (K Williams), lodged a protest against the winner "PASCO" (E Whittle).

DECISION AND REASON
--Following the running of Race 1, Mr P J Williams, the trainer of the 3rd place horse "AL FAROUK" (K Williams), lodged a protest against the winner "PASCO" (E Whittle).
--The margins were a short head between 1st and 2nd, and half a head between 2nd and 3rd.
--Mr Williams gave his reasons for the protest. He claimed that "PASCO" dictated the line of "AL FAROUK" in the run for the finishing line. He demonstrated the matters which gave him concern. He alleged that "AL FAROUK", when racing in close quarters with "PASCO" and "GLOBAL SAINT", was inconvenienced in the first instance by "GLOBAL SAINT" which meant that his jockey then had to move out in order to find racing room. As soon as a gap appeared, "PASCO" moved further out taking "AL FAROUK" with it. He pointed out how "AL FAROUK" in the process clipped a heel of "PASCO", thereby inconveniencing "PASCO" further. He conceded that the interference was not significant, but alleged that his horse was inconvenienced to such an extent that it was denied a chance of finishing in a better place. He felt that his horse was denied 2nd place at the least. His jockey, Ms K Williams, said that she called out to Ms E Whittle, at least five times, to "move out". Mrs D Pitman, representing the trainer and connections of "PASCO", agreed that the movement occurred in the way that Mr Williams alleged, but said that in her view "AL FAROUK" did not need to move out ? and had it stayed on its line it would have had a clear run.
--The view of Stipendiary Steward Mr S C Ching was that he agreed that "AL FAROUK" had been inconvenienced, but that it was over to the Judicial Committee to decide if the inconvenience constituted interference sufficient to warrant a change of placings.
--Decision
--In considering a protest a judicial committee needs to look at the totality of the interference complained of, and in the process examine the build up to the incident, the incident itself and the aftermath.
--"The Build Up"
--"AL FAROUK" was racing in close quarters to "PASCO" and "GLOBAL SAINT". "GLOBAL SAINT" moved outwards, inconveniencing "PASCO". The rider of "PASCO" elected to go outside of "GLOBAL SAINT". Ms Williams called out for racing room. Ms Whittle provided that racing room.
--"The Incident"
--"AL FAROUK" was presented with racing room. Instead it followed the track of "PASCO" and got sufficiently close to "PASCO" and clipped a heel. After losing some ground "AL FAROUK" then ran on doggedly and achieved 3rd place.
--"The Aftermath"
--Ms Williams, after moving out with "PASCO", then had to change ground to find racing room again.
--Our task, after considering the matters set out above, is to decide whether or not there was interference, and if so was it sufficient to warrant a change in the placings.
--Our firm conclusion is that there was not any interference. Inconvenience by its definition is not, in racing terms, sufficient to constitute interference. In any event we have reached the view that "AL FAROUK" was the author of its own misfortune. Ms Williams called out for racing room. It was given to her but "AL FAROUK" went out with it. We do not find that "PASCO" dictated the line of "AL FAROUK".
--Having reached the above findings of fact we therefore dismiss the protest.
