Penalty:

Mr Bradley's licence to ride is suspended from the close of racing on Saturday 15 November up to and including racing on Sunday 23 November 2014. The suspension incorporates the Woodville (19th), Taranaki (21st), Rangitikei (22nd) and Cambridge (23rd) meetings. 

Facts:

Following the running of Race 2 (The Robyn Mactaggart Cup 2100m), Information A6772 was filed with the judicial committee. It alleged that: "Mr Bradley allowed his mount SATAY to shift in near the 100 metre mark with a circuit to run and check SAVAROSE". 

Using the head-on, side-on and rear films, Mr Goodwin demonstrated that as the field travelled down the straight on the first occasion, Mr Bradley (SATAY) was seeking to move inwards near the 100 metres in front of SAVAROSE (Miss Goldsbury) who was located four from the outside. The stewards believed that Miss Goldbury had given Mr Bradley an indication that there was room for him to move inwards as she pulled back on her mount, but in moving inwards, Mr Bradley was not the required distance clear, and SAVAROSE had clipped heels as a result. Mr Goodwin submitted Mr Bradley had simply misjudged the distance on this occasion.

Mr Bradley stated that while he had been careless, he had been caught wide, and was not seeking to move inwards immediately. He attempted to undertake the movement as safely as possible, but he was not sufficiently clear at the time.

Submissions for Penalty:

In presenting Mr Bradley's record, Mr Goodwin identified that he was a busy rider who had previous charges of careless riding on 19 and 14 December 2013 for which periods of suspension were imposed. Accordingly, the stewards submitted that Mr Bradley's record was very good. The stewards believed the degree of carelessness to be below the mid-range.

Mr Bradley agreed with Mr Goodwin's summary of his riding record and emphasised that he tried to be as safe as he could whilst being as competitive as he could. He submitted that he had been riding up North and down South this season. He also indicated his preference for any period of suspension, if imposed, to be deferred until the conclusion of racing on Saturday 15 November to allow him to fulfil engagements.

Reasons for Penalty:

The committee considered all of the submissions placed before it and believed a period of suspension was appropriate, adopting a five day starting point. The committee independently assessed the level of carelessness to be below the mid-range. It occurred at a stage of the race, shortly after dispatch, when runners from a wide running are seeking a run closer to the rail. An opportunity arose, and Mr Bradley took advantage of it. Whilst Miss Goldsbury clipped heels, the committee must consider the level of Mr Bradley's carelessness in not being sufficiently clear when moving inwards. In mitigation the committee considered his early admission of the breach and his very good riding record having received two periods of suspension within the last 12 months for someone who is a very busy rider. On balance, the committee considered that a four day period of suspension was appropriate.
