R. Myers, the rider of Words of Wisdom, allowed her mount to shift inward near the 900 metre mark when not clear of Vola Via (K. Hercock) which was checked and went back onto Out Back Fox (H. Tinsley) and Zagazig (R. Hannam).

Rule 638 (1) (d) was read and Miss Myers confirmed her understanding of the rule and her admittance of the breach. Licensed trainer Mr. P. Campbell was present and represented Miss Myers.

Stipendiary Steward N. Goodwin showed the available films and pointed out the alleged incident which showed Miss Myers mount having drawn the outside rolling inwards causing the horse on her inside to be checked. Her continuance of that inward movement caused further tightening to the horses on her inside, Vola Via which, having been checked, went back onto Out Back Fox and Zagazig.

Miss Myers informed the committee her mount, Words of Wisdom, was racing fiercely and when moving across she did hear Miss Hercock call. She felt she did pull off but felt Jockey Hercock’s mount was over racing at the time.

Her continuing movement inwards did she concede cause further tightening to the horses on her inside, she was adamant however that there was no calling from the jockeys on her inside.

Stipendiary Steward M. Davidson informed the committee Miss Myers was last suspended under rule 638 (1) (d) at Rotorua in November, the period of suspension imposed was 4 days. She was a busy rider who had made a big impression in the relatively short time she has been riding. He felt that the breach was in the mid range and asked for a period of suspension of 4-5 days.

Miss Myers informed the committee that she had accepted for three rides on Saturday at Woodville but had contacted the two trainers involved, Mr. Breslin and Mr. Mathews to ask for a release from the confirmed mounts as she wished any period of suspension imposed to begin after racing today. This had been agreed to by both trainers. Stipendiary Steward M. Davidson agreed to the course of action placed before the committee.

Miss Myers, in coming to our decision to impose a period of suspension for this breach of rule 638 (1) (d), we have taken into account your admittance of the breach and your record under this rule. We concur with the comments made by Stipendiary Steward Davidson that you are a busy rider with a good record. However, in this case you actions resulted in three horses being checked in two separate incidents in your endeavour, having drawn the outside, to get your mount across as quickly as possible. We have carefully considered your request to have a period of suspension beginning immediately even though rider declarations have been declared for Saturdays racing at Woodville.

We are prepared to accept your word that after discussions with both Mr. Breslin and Mr. Mathews, trainers of the horses affected, both have agreed to release you from engagements.

We wish to point out that this is not an automatic right but must be viewed on its merits and on a case to case situation. The reason for the rule is so that owners and trainers are not let down, by having their first agreed jockey forfeiting the ride.

We have decided to agree to your request and impose a period of suspension beginning after the completion of racing today, Thursday the 7th of January 2010, until the completion of racing on Friday the 15th of January 2010 – 4 riding days.
