As Mr Johnson admitted the breach we found the charge proved.

Penalty:

The Committee took into account Mr Johnson’s upcoming riding commitments and accordingly suspend his license from the close of racing today, Saturday October 6th up to and including racing on Friday October 19th.

Following clarification from the Stewards the rescheduled Riccarton meeting for Tuesday October 9th was not considered due to the same fields and riders being declared.

Facts:

Following the running of Race 2 (Mardigras Events 1200), an Information was lodged by Mr J Oatham alleging that jockey Chris Johnson permitted his mount to shift inwards near the 250m crowding STRADIVARIUS.

Mr Oatham had Mr Goodwin explain the incident with the assistance of the available films. Mr Goodwin said the incident occurred soon after the field entered the home straight. Mr Pinn angled out for a run at the same time as the leading horse (VINNIE’S VOLLEY) moved in towards the rail. This left a large gap available for Mr Pinn to improve into between VINNIE’S VOLLEY and GIFT OF POWER (C Johnson). Mr Goodwin said it appeared that Mr Johnson angled GIFT OF POWER inwards in an attempt to protect his line of running. As a result, he made contact with Mr Pinn’s mount and both horses became unbalanced.

Another narrow gap appeared for Mr Pinn and again he tried to take it, but GIFT OF POWER moved inwards a second time moving Mr Pinn in behind the leading horse, which did come back out.

Mr Johnson declined to comment on the films but, when asked by the Committee, confirmed he was satisfied with the way Mr Goodwin had explained the incident.

Mr Oatham presented Mr Johnson’s riding record for breaches of the careless riding rule over the last 12 months.

He said Mr Johnson was one of the country’s busiest riders and this time last year he went through a bad patch where he was suspended three times in two days. Mr Oatham said these three charges were close to dropping off the 12 month period and due to the number of rides Mr Johnson has the Stewards considered his record to be a relatively good one.

Today’s incident resulted in a relegation and assessing all factors the Stewards placed the degree of carelessness in the midrange.

Mr Johnson declined the request to put forward any submissions on penalty. In response to a query from the Committee on his upcoming riding engagements Mr Johnson was specific in that any suspension could start immediately.

Reasons for Penalty:

In coming to a decision on penalty the Committee took into account all of the submissions. It was our opinion that the degree of carelessness was above midrange. We based this on the fact that Mr Johnson continued to place pressure on STRADAVARIUS over some distance, and as a result he denied that runner a better placing.

Referring to the Penalty Guide for Judicial Committees we adopted a starting point of 9 days suspension. Mitigating factors were Mr Johnson’s admission of the breach while his record was viewed as neutral.

Balancing up all factors we determined that an appropriate penalty was one of 8 riding days.
