The protest was dismissed and the Judge's placings allowed to stand with all dividends to be paid accordingly.

Facts:

Following Race 3, the Stella Artois Premier 1600m, a protest was lodged pursuant to rule 642(1). Mr Waddell alleged that horse number 8 (ESTRATO) or its rider placed 2nd by the Judge interfered with the chances of horse number 3 (DOUBLE O SEVEN) placed 3rd by the Judge.

The interference occurred in the final straight.

Judge's placings were:

1st RANSOMED

2nd ESTRATO

3rd DOUBLE O SEVEN

4th LIV'N PARADISE

5th IS DA CHIEF

6th CLASSY MATTER

The official margins were a neck between first and second and a half length between the second and third horses.

Submissions for Decision:

Mr Waddell started with the head-on video and showed that at approximately the 150m ESTRATO shifted in and closed the gap in front of him. At the 100m he was travelling in a position 1- 2 lengths behind ESTRATO but making up ground quickly. At the finish post he was only half a length behind and Mr Waddell said  with a clear run he would have easily beaten ESTRATO. He used the side view to highlight how much ground he was making up on the second placed horse.

Mr Cullen (co-trainer DOUBLE O SEVEN) said the gap was there for Mr Waddell to take but when it closed he had to restrain his horse resulting in a loss of momentum and then make up ground over the final stages. Mr Lowry (co-trainer DOUBLE O SEVEN) said his horse would definitely have run second but would probably have won the race with a clear run.

Mr Coleman acknowledged his mount ESTRATO shifted inwards approximately half a horse width but used the rear-view video to show Mr Riddell's horse LIV'N PARADISE move outwards at the same time contributing to the incident.  He said both horses were culpable. Mr McKay (trainer ESTRATO) said there was only ever a split second gap for DOUBLE O SEVEN to take and that gap closed because both ESTRATO and LIV'N PARADISE moved briefly off their running line.

For the Stewards Mr Neal said DOUBLE O SEVEN was obviously held up early in the straight when going for a marginal run between ESTRATO and LIV'N PARADISE but that both horses moved off their lines simultaneously contributing to the gap closing.

Reasons for Decision:

The committee carefully considered all of the evidence and we looked again at all three views of the incident. We found that ESTRATO moved inwards first but then LIV'N PARADISE moved out slightly contributing to the gap closing which caused tightening to DOUBLE O SEVEN. Mr Waddell's horse ran on strongly and could be considered unlucky as he was certainly making up ground at the finish however due to LIV'N PARADISE contributing to the incident we could not find ESTRATO soley to blame.
