 As Mr Riddell admitted the breach we found the charge proved.

Penalty:

 Taking into account upcoming riding commitments Mr Riddell is suspended for 5 days from the close of racing on Saturday October 12th up to and including racing on Saturday October 19th.  Race days in this period are:

14/10/13                              Paeroa

16/10/13                              Whangarei

17/10/13                              Woodville

18/10/13                              Tauranga

19/10/13                              Otaki/Rotorua

Charge:

Following the running of Race 10, the Let’s Go to Turks Spring Finale, an Information was lodged by Mr R Neal alleging a breach of Rule 638(1) (d) in that J Riddell (ZA PAK) allowed his mount to shift in near the 200 metres crowding URUNGA which had to be checked.

Facts:

Using the head-on video Mr Oatham showed URUNGA racing in a position adjacent to the running rail. Mr Riddell (ZA PAK), who was travelling better, went past on the outside but as he did so ZA PAK laid in on URUNGA causing interference. Mr Oatham synchronised the side-on video to show that at the time of the incident Mr Riddell was only a bare length clear of that runner and was therefore in breach of Rule 638(1)(d).

Mr Riddell said URUNGA was “going nowhere” while his horse was travelling far better. He believed he was well past when ZA PAK laid inwards but, admitted after seeing the films, that he wasn’t.

Submissions for Penalty:

Mr Neal produced Mr Riddell’s riding record which showed five careless riding charges over the preceding 12 month period.

Mr Neal described this as a reasonable record considering Mr Riddell's busy schedule. He described the incident as an error of judgement and below mid-range in severity. The Stewards’ submission was for a period of suspension in the region of 4 – 6 days.

Mr Riddell admitted that URUNGA was checked and said he simply misjudged the distance between the two horses. 

Reasons for Penalty:

In coming to a decision on penalty the committee took into account all of the submissions and adopted, as a starting point, a period of five days suspension. Mr Riddell was succinct with submissions and did not make any excuses. We accept that he made a mistake by allowing his mount to move inwards when not the required distance clear. Fortunately, the consequences of his actions were not severe with the films confirming that while URUNGA was checked, the incident did not affect that horse’s chances of gaining a dividend-bearing position.

The committee also took into account Mr Riddell’s admission of the breach and his record which we considered to be neither a mitigating nor aggravating factor.
