Facts:

C. Carmine, the rider of Bandit Country, admitted breach of rule 638 (1) (d) that he allowed his mount to shift in near the 200 metre mark when not clear of Princess Lincoln causing that runner to be crowded for some distance.

Neither parties had further comment.

The charge was admitted.

Submissions for Penalty:

Mr. Goodwin told the committee that Bandit Country was being ridden with vigour and on rounding the bent it started to move inwards. He believed the movement was gradual but contact was made with Mr. Bradley’s mount which necessitated that jockey to take hold. There was, he believed, no great checking to Princess Lincoln and felt the incident was in the lower to mid range.

Mr. Carmine was a North Island rider only and his record under this rule since early December when he was suspended for 4 days was good. Mr. Carmine confirmed he was a North Island rider only and asked any suspension imposed to begin after racing today.

Mr. Carmine, in coming to our decision to impose a period of suspension for this breach, we have taken into account your admittance of the breach and your record. We view the breach in the mid range, you did move inwards causing Mr. Bradley to take hold of his mount. As indicated in the previous information we did give credence to comments referring to the race day behaviours of 2 year olds, but still believe you could have exercised greater control of Bandit Country’s inward movement.
