Facts:
Following the running of Race 2, Animal Therapeutics Online Maiden, an Information was lodged by Mr N Goodwin alleging a breach of Rule 638(1) (d) in that J Riddell the rider of MISS IRENE allowed his mount to shift in when insufficiently clear of PRIDE ROCK which clipped that runner's heel and blundered.
Mr Riddell (MISS IRENE) jumped from barrier 10 and soon after the start angled his mount inwards in an effort to move closer to the rail. As he went forward he was not the required distance clear of PRIDE ROCK which had jumped from barrier 8. As a result Mr Stam clipped a heel, stumbled and nearly fell. The side on view showed Mr Riddell was only approximately one length clear of that runner when he crossed.
Mr Riddell admitted to not being clear but said he was unaware of the incident until he saw the films afterwards in the Stewards’ room.
Submissions for Penalty:
Mr Goodwin produced Mr Riddell’s riding record which showed four careless riding charges over the preceding 12 months with the most recent being in February this year. He described this as a very good record considering the number of rides Mr Riddell has. In response to a question from the committee Mr Goodwin classed the degree of carelessness as below mid- range. The Stewards’ submission was for a period of suspension of four days.
Mr Riddell said, in his opinion, it was a very minor breach and submitted that a three day suspension was more appropriate. He said his horse was laying in slightly and he was trying to keep it out and stay clear of the other riders but he did not realise that Mr Stam was in the position he was.
Reasons for Penalty:
In coming to a decision on penalty the committee took into account all of the submissions and adopted as a starting point a period of five days suspension. We then applied mitigating and aggravating factors. We gave credit for Mr Riddell’s admission of the breach but this was the only mitigating factor we identified. In relation to his riding record our opinion varied from that of the Stewards when they submitted that four breaches in 12 months was a very good record. We considered his record a neutral factor, neither very good nor poor. The committee classed the breach as midrange. We were of the opinion that even though the movement was gradual Mr Riddell should have done more to ensure that he was the required distance clear when crossing from a wide draw. The consequences of his actions resulted in severe interference to PRIDE ROCK as that horse clipped heels and nearly fell. Mr Stam confirmed his horse clipped a heel and did not stumble of its own accord.
Balancing up all the factors it was our opinion that a five day suspension was an appropriate penalty.
