Decision: Following Race 5 an information was filed pursuant to Rule 871 (1) (d) by the informant, Chief Stipendiary Steward Mr Cameron George.  He alleged that Mr M Coleman, rider of ALTERED IMAGE, permitted his mount to shift outwards near the 200 metres when not clear of FIREBOLT, VINCENT MANGANO and RUBIN CARTER, which  were all checked

Following Race 5 an information was filed pursuant to Rule 871 (1) (d) by the informant, Chief Stipendiary Steward Mr Cameron George.  He alleged that Mr M Coleman, rider of ALTERED IMAGE, permitted his mount to shift outwards near the 200 metres when not clear of FIREBOLT, VINCENT MANGANO and RUBIN CARTER, which  were all checked.

Mr Coleman admitted the breach.

Mr George demonstrated the video films and showed at the 200 metre mark Mr Coleman angle his mount out when insufficiently clear, causing severe interference to three runners.

PENALTY

--

Mr George submitted that this was interference at the highest end of the scale.  He said it was a lengthy shift outwards enabling ALTERED IMAGE to finish third, whilst in doing so severely affecting the chances of three other runners.  Mr George submitted a 3 – 4 week suspension and a $4,000 - $6,000 fine in accordance with similar offences.

Mr Coleman admitted he dictated the line of the horses on his outside but it was not a deliberate move.  He said the head wind made it more difficult to determine margins.

DECISION

--

The Committee gave considerable thought to all submissions and before imposing penalty took into account the following :

--

1.            Mr Coleman’s Guilty plea.

--

2.            His excellent riding record.

--

3.            Status of the race and the consequences as stated in Rule 1122 (2).  The consequences in this case were that three runners all had their chances virtually extinguished at a vital stage of the race.

--

4.            Level of interference and the effect on three other runners.

--

5.            Mr Coleman did not attempt to stop riding at any stage during his sustained outward movement.

--

Normally we believe this type of offence would warrant a 4 week suspension and an accompanying fine.  However, taking into account Mr Coleman’s outstanding record and his Guilty plea, we give him a week’s concession and impose a 3 week suspension, starting after racing on 04 October and concluding after racing on Saturday 25 October 2008.  In addition, we impose a fine of $5,000.
