Decision:

Following Race 3 an information was filed pursuant to Rule 871 (1) (d) by the informant Chief Stipendiary Steward Mr Cameron George.  He alleged that Mr J Waddell allowed his mount to shift outward in the early part of the home straight when not clear of FUJI EXTREME causing this horse to check.  CASTLES BURNING was also hampered in the incident.



Following Race 3 an information was filed pursuant to Rule 871 (1) (d) by the informant Chief Stipendiary Steward Mr Cameron George.  He alleged that Mr J Waddell allowed his mount to shift outward in the early part of the home straight when not clear of FUJI EXTREME causing this horse to check.  CASTLES BURNING was also hampered in the incident.

Mr Waddell admitted the breach.

Mr  George showed the video films where Mr Waddell shifted outwards 2 – 3 horse widths in the early part of the home straight, taking the line of FUJI EXTREME when insufficiently clear.  This also resulted in CASTLES BURNING being hampered.

PENALTY

--

Mr George produced Mr Waddell’s record, showing only one charge since April.  He submitted a suspension of 5 – 6 days would be appropriate.

Mr Waddell believed his breach was a minor one and told the Committee his commitments through until racing on the 11th of October.

The Committee considered all submissions and before imposing penalty took into account the following:

--

1.            Mr Waddell’s good record

--

2.            His Guilty plea

--

3.            Level of interference

--

 Accordingly, we impose a suspension to start after racing on 11 October 2008 and to conclude after racing on 18 October 2008 (5 days).
