Facts:

Following the running of Race 9 (Tarzino Trophy Group 1) Information No. 12296 was filed with the Judicial Committee. It was alleged by the Informant Mr Oatham that Mr McNab made a Celebratory Gesture prior to the finish of the Race.

Mr McNab said that he understood the Rule and confirmed that he admitted the breach.

Mr Oatham showed the film replays and said that the film evidence spoke for itself.

Mr McNab said that he told himself 4 times not to go up, but that he still did.

Submissions for Penalty:

Mr Oatham said that back in 2017, Mr McNab was fined $400 for a similar breach in the Manawatu Sires Produce Stakes. He advised the Committee that in more recent times fines of $500 and $400 had been imposed when the breach occurred in Group Races.

Mr McNab did not comment on penalty.

Reasons for Penalty:

It is a Rider’s obligation to have proper control of their mounts at all times, as safety in race riding is of the utmost importance. Mr McNab’s action of standing high in the saddle, turning his body to the crowd, and pumping the air demonstrated that he would have had very little if any control of his mount at that time. Taking into consideration all aspects in relation to penalty, the Committee determined that a fine was a suitable sanction for this particular breach of the Rule.
