Decision: Miss H. Moki was charged with Rule 871(1)(d) - Careless Riding - in that she allowed her mount to shift inwards after the start on Lady Babs when not sufficiently clear of JackZamon (L. Allpress). 

Miss H. Moki was charged with Rule 871(1)(d) - Careless Riding - in that she allowed her mount to shift inwards after the start on Lady Babs when not sufficiently clear of JackZamon (L. Allpress).  Miss Moki did not admit the breach of the rule.

 Mr. Goodwin (Stipendiary Steward) called jockey L. Allpress rider of JackZamon as a witness.

She informed the committee that she was free of interference in a forward position ? length off the lead when she saw Miss Moki's mount coming across.  Her mount was tightened and she had to take hold effecting the horses on her inside.  She lost at least ? a length but the inside horses were more affected.  Mr. N. Goodwin asked if she had called and she confirmed she did.  When asked if contact was made initially she wasn?t sure then confirmed that there was contact with the horse on her inside.

 Mr. B. Herd by was of questions asked if her horse had overreacted as it was racing in blinkers for the first time.  He also asked if she had to take hold for only a few strides.  L. Allpress reiterated that she had not overreacted and she certainly took hold for more then a few strides.

 Mr. J. Oatham (Stipendiary Steward) showed the two available films.  The head on film showed, he believed, that Miss Moki came swiftly across on a very sharp angle and was not sufficiently clear.  the film showed clearly that jockey Allpress had to take hold of her mount.  He believed that it was difficult to see on either of the films whether contact was made.

 Mr. B. Herd on behalf of Miss Moki informed the committee that there was little doubt that Miss Moki had come across.  He believes L. Allpress took hold of her mount and that it had overreacted.  He told the committee that the movement of the inside horses was made to look worse than it was and was caused by the condition of the ground down on the inside.  Miss Moki informed the committee that it was the horses first time in blinkers.

 Mr. Goodwin, in summing up, informed the committee that he believed the head on film showed clearly the movement inward by Miss Moki's mount, she looked and kept coming across.

 At the recommencement of the hearing, Miss Moki and her representative Mr. B. Herd were given the opportunity to change their plea on the charge.  After discussion this was declined.

 Decision and reason:

--

Miss Moki, the committee has carefully considered the evidence placed before us and have viewed again the available films.  The rules are quite clear and you are obviously aware of the distance required when crossing.  The films, especially the head on, show that your sharp inwards movement did cause tightening to L. Allpress' mount which in turn caused tightening to horses on its inside.

We find the charge proven.

 Penalty:

Mr. N. Goodwin informed the committee that this was Miss Moki's first charge under this rule.  She had received a warning under the rule on the 24th of June.  Mr. Goodwin indicated he believed it was an incident that required a period of suspension.

 Miss Moki informed the committee that she intended to ride on Wednesday at the National meeting and stay down hoping to pick mounts up on Premier day (Saturday) because of her claim.  She had one confirmed mount for Wednesday.  Mr. Herd asked the committee to take into account Miss Moki's record, she has been riding 12 months and this was her first charge.

Miss Moki, in arriving at our decision to suspend you from race riding, we have taken into account that this is your first charge.  We have also taken into account your confirmation of your intention to ride in the South Island over the carnival even though you have not ridden in the South Island before, and that one race day is a premier day.  The committee however believes that this was a breach of the rule.  Your actions caused tightening to a number of horses.  The committee has decided to suspend you from race riding after the completion of racing on Saturday the 5th of August until the completion of racing on Saturday the 12th of August.  (3 riding days)
