Facts:
Following the running of Race 2 (Prodrive Golf Wellington 2YO), an Information was lodged by Mr N Goodwin alleging a breach of Rule 638(1)(d) in that jockey R Jones allowed his mount COME IN SPINNER to shift inwards when not sufficiently clear of WISHFUL passing the 100m causing a check to that runner.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Jones confirmed to the Committee that he understood the charge and that he admitted the breach.
Mr Balcombe explained the incident using front, side and rear view films. Mr Jones (COME IN SPINNER) was the widest runner on the track and began to run inwards while under a vigorous ride. Mr McKay (WISHFUL) was finishing strongly from a position further back in the field but had his run taken when Mr Jones came across in front of him.
Mr Jones explained that he was on a 2yr old having its first start. His horse was moving inwards heading towards the rail but he stopped riding to straighten its line of running when he saw he was getting close to Mr Riddell. Unfortunately the greenness of his horse and its momentum carried it inwards further than expected. Mr Jones admitted causing interference to Mr McKay’s mount but said he was not aware of that runner coming up quickly from back in the field. Mr McKay did not call out and if he had known Mr McKay’s position he would have straightened his mount up earlier.
Submissions for Penalty:
Mr Goodwin admitted there was merit in Mr Jones’ defence but nevertheless he placed the breach in the midrange. He said the Stewards had no record of Mr Jones being charged with careless riding and Mr Jones said it had been many years since he had breached the careless riding rule. The Stewards’ submission was for a period of suspension.
Mr Jones, while admitting the breach, asked the Committee to consider his excellent record and the fact that his horse was slow to respond when he corrected its line of running. He advised of commitments at Matamata on Wednesday May 3rd. The Committee questioned Mr Jones on his regional riding pattern and he told us he had ridden at Riccarton one week ago and he rode in the Central Districts when opportunities arose, including industry days. This was confirmed by the Stewards.
Reasons for Penalty:
The Committee advised Mr Jones of the five day starting point for careless riding charges as outlined in the Penalty Guide for Judicial Committees. We were satisfied by the video evidence that Mr Jones straightened his horse up when he came close to Mr Riddell’s mount but being an inexperienced 2 year old the horse took a couple of strides to respond. Mr Jones was clearly in no position to see Mr McKay running on quickly from behind. We placed his level of carelessness in the low range.
Mr Jones has a clear record under the careless riding rule with no breaches on recent records.
Taking into account Mr Jones’ admission of the breach, the low level of carelessness and his exceptional record we applied a two day discount from the starting point imposing a three day suspension.
