--Mr Hawea called as a witness, Jockey M Lammas, rider of SHELLl. He informed the committee that his mount received pressure from the outside horse ridden by M Cameron.
--Miss Hercock asked if he was hunting for a gap.
--Mr Lammas said he was travelling well and entitled to be where he was.
--Mr Cameron, rider of VIKING FLAGSHIP told the committee that he drew 4. C Lammas was inside and the pressure came from the outside ( C Te Maari)
--Mr Te Maari, rider of MONSOON told the committee he was three wide. R Stam's mount was ? length clear when the pressure came and he had to take hold. His horse threw its head around.
--R Stam, rider of YEAH NAH said he was under a hold, received pressure from the outside and this caused a chain reaction to the horses on his inside.
--His line was dictated to by Miss Hercock's mount and her actions. He was entitled to be where he was.
--Stipendiary steward N Goodwin showed the head and side on films. He pointed out that Miss Hercock's mount, shortly after the start , moved inwards. The horse's head was on its side. The mount caused pressure to the horses on her inside. He felt she was not sufficiently clear and it was her actions alone that caused the interference to the horses on her inside.
--Mr K Hawea, stipendiary steward told the committee that Miss Hercock was not sufficiently clear. She dictated the lines and actions of the horses on her inside by her movement inwards.
--Mr B Herd told the committee that Miss Hercock's mount did move inwards but the riders on her inside did not help her by not reading the race. He felt Miss Hercock was unlucky.
--Miss Hercock, by way of an answer to a question by Mr Hawea told the committee she did not hear Mr Stam call but heard other jockeys.
--DECISION AND REASON
--Miss Hercock?..We have viewed the films available and listened to the evidence presented. Mr Herd clearly pointed out that your horse did move in.
--The films clearly showed the pressure on the horses affected was caused by your mount moving inwards. Mr Herd's comments concerning the jockeys affected and being placed in the circumstances they found themselves in was noted. However all of the four riders concerned were entitled to be where they were at that stage of the race and that the tightening and interference that happened were a result of your actions. Therefore the breach has been found proven.
--PENALTY
--Mr Hawea informed the committee that Miss Hercock had been charged under this rule on 23 June 2004 (4 days)
--31 March 2004 (4 days)
--8 March 2004 ( 4 days)
--19 January 2004 (4 days)
--He asked for a period of suspension as he felt it was a serious breach of the rule.
--Miss Hercock asked for a fine as she had good mounts coming up, including a ride in the Cuddle Stakes next Tuesday.
--DECISION
--The committee at the outset informed Miss Hercock this breach could not be handled by way of a fine. The committee expressed its concern at the number of charges Miss Hercock had been found guilty of under this rule this year.
--Her actions caused interference to a number of horses.
--Miss Hercock was suspended from riding after racing this Saturday 30 October until the completion or racing on Tuesday 9 November. Five racing days.
