Facts:
Mr Goodwin lodged an information with the Judicial Committee alleging a breach of Rule 330 (3) (c) in that rider P Holmes failed to make the contracted weight on BERG EN DAL.
Mr Holmes accepted the ride on BERG EN DAL at a weight of 54kgs. On the morning of the races Mr Miribelli rang Mr Goodwin to advise him that Mr Holmes would be unable to make the weight and to seek a replacement rider. Mr McNab gained the ride.
Mr Holmes had nothing to add but in answer to a question from the committee advised that he had ridden very recently at 54kgs.
