As Ms Myers admitted the breach we found the charge proved.

Ms Myer’s license is suspended from the close of racing on Saturday May 5th up to and including racing on Saturday May 12th.
Facts:
Following the running of Race 4 (Hawke’s Bay Owners Association 1200), an Information was lodged by Mr N Goodwin alleging a breach of Rule 638(1)(d) in that Ms Myers angled her mount ZAPPEUR out when not sufficiently clear of ONE PRIZE ONE GOAL near the 500metres which clipped a heel and blundered.
Mr Goodwin had Mr Jones outline the incident using all the available films. Just before the home turn he identified Ms Myers racing behind WONDER WOMAN in a position “one off” the fence. Ms Hemi riding ONE PRIZE ONE GOAL was behind her and to her outside. Ms Myers angled out from behind WONDER WOMAN, to improve to its outside, but was not clear of Ms Hemi when she did so. Ms Hemi was forced to take a hold and clipped a heel of Ms Myers mount. Mr Jones showed where Ms Myers had moved to a “three wide” position and had not been the required distance clear of Ms Hemi when she did so.
Ms Myers said she was not aware of Ms Hemi improving quickly behind her. There had been no calling and she believed her outward movement had been minimal.
Submissions for Penalty:
Mr Goodwin submitted that a term of suspension was an appropriate penalty. He said while Ms Myers had an obligation to move out only when clear of other riders, Ms Hemi had improved rapidly to her outside making it difficult for Ms Myers to see her. Further Ms Hemi told the Stewards that she was having difficulty restraining her mount as it had “no mouth”. Mr Goodwin placed the consequences of the interference in the midrange.
Mr Goodwin said Ms Myers had an excellent riding record with no careless riding charges since 2016.
Ms Myers advised of riding commitments through until next Saturday and requested a seven-day deferment of any suspension.
Reasons for Penalty:
We place the level of carelessness in the low range. Ms Myers made a run to the outside of WONDER WOMAN in a measured and controlled manner. She did not barge her way out of a tight space, nor force another runner over extra ground. She was perhaps a little unlucky that Ms Hemi was improving so quickly from a position behind her and did not call out. Nevertheless, Ms Myers was not the required distance clear when she moved out and as result Ms Hemi clipped a heel and blundered. Taking into account the consequences we place the overall breach between low and midrange. We adopted a starting point of seven days’ suspension.
There were no aggravating factors.
The NZTR website has Ms Myers last suspension for careless riding in November 2016. This is an exceptional record for a rider as busy as Ms Myers. To date for the 2017/18 racing season, she has had 530 rides.
Taking into account her excellent record and admission of the breach we have afforded Ms Myers a two-day reduction from the starting point. An appropriate penalty is a suspension of five days.
