 As Ms Dravitzki admitted the breach we found the charge proved.

Penalty:

 Ms Dravitzki is suspended from the close of racing on Saturday June 1st up to and including racing on Monday June 10th. Race days in this period are:

5/6/13 Matamata

6/6/13 Taranaki

8/6/13 Wellington

10/6/13 Waverley

Charge:

Following the running of Race 8, the Roots, Shoots and Fruits Metric Mile, an Information was lodged by Mr N Goodwin alleging a breach of Rule 638(1) (d) in that M Dravitzki permitted her mount “ANDALOU” to shift inwards when not sufficiently clear of “ASSASSIN” which was forced inwards crowding “SAVAROSE” which clipped a heel and blundered near the 1450m.

Facts:

Mr Goodwin read the rule and Ms Dravitzki said she understood the nature of the charge and confirmed that she admitted the breach. Ms Dravitzki is an apprentice rider and had Mr Kim Treweek to assist her.

Race 8 was an apprentice rider’s only race run over a distance of 1600m. Mr Oatham showed the rear-view film of the start and identified the runners involved in the incident. Ms Dravitzki was riding ANDALOU which had drawn barrier number 9; ASSASSIN was in barrier number 8 and SAVAROSE barrier number 7. Soon after the start Ms Dravitzki angled her mount inwards but in doing so was not the required distance clear of the horse to her immediate inside which was ASSASSIN ridden by Mr Dylan Turner. Mr Turner was then forced inwards causing SAVAROSE ridden by Mr K Kalychurun to be checked. The side-on film showed SAVAROSE get tightened for space, blunder and nearly dislodge the rider.

Ms Dravitzki told the committee the incident was a misjudgement on her behalf and she was not aware there were so many horses on her inside. She made the mistake of using the inside horse as a guide and misjudged the distance she was clear. Mr Treweek, who was supporting Ms Dravitzki, said that the race was for apprentices only and the inexperience of many of the riders led to a pressure point of runners on the fence adding to the interference.

Submissions for Penalty:

Mr Goodwin produced Ms Dravitzki’s riding record which showed the following suspensions:

28/2/13            4 days

20/12/12          4 days

11/9/12            3 days

He said hers was an improving record as she was getting many rides. The stewards’ submission was for a suspension of not less than 5 days.

Ms Dravitzki said she thought a 5 day suspension was a fair penalty under the circumstances and informed the committee that she only rode within the North Island. She advised of riding commitments through until Saturday June 1st.

Reasons for Penalty:

The committee took into account all of the submissions and adopted as a starting point, a period of five days suspension. It was our opinion that Ms Dravitzki’s record did not warrant a reduction in penalty however we did give credit for her admission of the breach. We assessed the degree of carelessness and the consequences to sit at mid range. Ms Dravitzki was never the required distance clear of the inside horse and as a result a runner was severely crowded and nearly fell. The inexperience of many of the riders may have played some part in the general crowding however it was the responsibility of Ms Dravitzki to be her own length plus one other clear before crossing. Through misjudgement she failed to exercise due care. Taking into account all of these factors we imposed a 5 day suspension. We were satisfied, that at this stage of her riding career, Ms Dravitzki rides only across the North Island.
