Decision:

Both runners MAILLY and THAT'S HOW WE ROLL were declared starters.

Facts:

At the completion of race 1 The Hawkes Bay Hunt Maiden Hurdle an Information was lodged by the stipendiary steward requesting a ruling under rule 632. The information stated.....to determine whether MAILLY (M Gillies) and THAT'S HOW WE ROLL (M Mitchell) were afforded a fair start.

Rule 632 states that:- if in the opinion of the judicial committee a horse that does not finish in the first three placings was prevented from taking an effective part in a race owing to the mechanical failure of starting stalls or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away by its own accord), the judicial committee may declare such horse to be a non-starter.

Submissions for Decision:

Stipendiary Steward N Goodwin, using the available films showed the committee the incident. Both the horses affected drew alongside each other (gates 9 and 10). Upon being released by the starter it was noticed that the horses (MAILLY M Gillies and THATS HOW WE ROLL M Mitchell) were slow away. It was pointed out that both gates were slow to open. Mr Goodwin believed the gates were only fractionally slow in opening and asked for a ruling under rule 632.

Starter Mr R Ripikoi submitted that until he saw the films he was unaware of the incident. From his position as starter he believed the start was fair.

Riders of the two horses concerned M Gillies and M Mitchell told the committee that in their opinion while the two gates were fractionally slow to open it did not affect either of their mount's chances. THATS HOW WE ROLL finished 6th one and a half lengths from 5th place and MAILLY finished towards the rear of the field. Both riders told the committee it was their intention to snag their mounts back after leaving the stalls and the fractionally slow opening of the gates allowed this to happen.

Mr Goodwin in summing up concurred with the submissions of both jockeys. He believed that while the gates were fractionally slow to open neither of the horses were affected.

Reasons for Decision:

In coming to its decision the committee viewed the available films. The elevated film at the start was particularly helpful. Gates 9 and 10 could be seen to be fractionally slow in opening. Both of the riders concerned were adamant that their beginning was not impeded by the gates and being slightly slower away did not affect their chances. The committee was mindful of the wording of rule 632 allowing for discretion in its interpretation.
