Decision:

Following the running of Race 11, the John McGifford Farewell, Mr. O Bosson was charged with careless riding under rule 871 (1) (d). The information alleged that approaching the 800m he permitted his mount “Sheeza Don” to shift in when not clear of “Harry Up” (D Walsh) which was taken in and had to be checked off the heels of “Miss Faberge”. “Spare A Fortune”, “Me And Max” also had to be checked.

Following the running of Race 11, the John McGifford Farewell, Mr. O Bosson was charged with careless riding under rule 871 (1) (d). The information alleged that approaching the 800m he permitted his mount “Sheeza Don” to shift in when not clear of “Harry Up” (D Walsh) which was taken in and had to be checked off the heels of “Miss Faberge”. “Spare A Fortune”, “Me And Max” also had to be checked.

Mr. Bosson admitted the breach of the rule.

Mr. Sanders played the videos of the incident which showed Mr. Bosson allowing his mount to shift inwards when not the required distance clear tightening “Harry Up” (D.Walsh) which then had to be steadied off the heels of “Miss Faberge”. “Harry Up” commenced to race fiercely and shifted inwards causing interference to two more horses. Mr. Sanders said that while Mr. Bosson had been careless the overreaction by “Harry Up” had to be taken into account.

Mr. Bosson’s only careless riding charge in the last 12 months was at Rotorua on the 18th October 2008 where he incurred a 3 week suspension and a $3000 fine. Mr. Sanders did remind the committee however that Mr. Bosson wasn’t riding for four months due to a disqualification on an unrelated charge.

In relation to penalty Mr. Sanders said that Mr. Bosson rides regularly in both the North and South Island and that his record was a good one. When asked Mr. Sanders put the degree of interference in the medium to high range but tempered that by saying that Mr. Walsh’s mount had overreacted which compounded the effect.

Mr. Bosson told the committee that due to riding commitments in the next 7 days he could begin any suspension after Saturday July 4th.

Penalty

In coming to a decision on penalty the committee considered all of the submissions put before it.

--

We have taken into account Mr. Bosson’s admittance of the breach, his very good riding record and the degree of interference that occurred.  Mr. Bosson’s careless riding amounted to an inward movement when only one length clear of  Mr. Walsh which forced “Harry Up” onto the heels of Miss Faberge. As a result of that initial interference Harry Up veered inwards to check two other horses.

Normally we would consider a five day suspension the  appropriate penalty in this situation with the number of horses affected however the Stipendiary Stewards have emphasized that Mr. Walsh’s mount overreacted and that Mr. Bosson could not be held totally accountable for the subsequent interference therefore we are prepared to reduce the suspension to one of four days.

Mr. Bosson is suspended from the conclusion of racing on Saturday July 4th 2009 until the conclusion of racing on Friday July 10th 2009.
