Jockey O Bosson admitted the charge of permitting his mount, Noahs Delight, to shift inward near the 100m mark when not clear of Absolutely Fabulously (B Lammas) dictating that runner inward onto the heels of Meduna (R Myers).

The rule was read and Mr Bosson confirmed his understanding of the rule and his admittance of the breach.

Stipendiary Steward Goodwin showed the available films of the incident pointing out that jockey Bosson allowed his mount to move inwards quite sharply forcing Absolutely Fabulously inward and onto Meduna.  He was concerned that at no time did Jockey Bosson stop riding and attempt to straighten.

Mr Bosson had no comment.

Submission on Penalty:
Stipendiary Steward Goodwin produced Mr Bosson record under this rule which showed he was suspended last at the CJC Carnival in November where he received a penalty of 4 days.

Prior to that a 4 day suspension was imposed on the 12/9/2009.  He asked for a five day suspension as he believed the offence could be classed in the mid-range.

Mr Bosson had no comment but did indicate he wished to ride at the Ellerslie meeting this coming Sunday and for any period of suspension to begin after that.
The Stewards had no concerns over the request.

Decision and Reason:
Mr Bosson, in coming to our decision to impose a period of disqualification for this breach we have given consideration to your guilty plea and your riding record which, taking into account the number of rides and venues you ride at, is very good.

However in this particular case we believe you showed an error of judgement in the middle range by allowing your mount to shift inwards and place pressure on the horses on your inside.

We were concerned you did not stop riding at the point of the incident and that two horses (one only slightly) were effected.  We have agreed to the course of action as suggested by you, and agreed to the by Stewards.

Mr Bosson, this committee has decided to suspend you from race riding after racing this Sunday, the 31st of January until the completion of racing on Saturday 6th of February (5 days).
