As Mr Riddell admitted the breach we found the charge proved.

Accordingly Mr Riddell is suspended from the close of racing on Saturday September 3rd up to and including racing on Friday September 16th. Race days included within this timeframe are:

10/9/16 - Manawatu
15/9/16 - Wanganui
16/9/16 - Taupo
Facts:
Following the running of Race 6, Redwood Spring Stayers 2000m, an Information was lodged by Mr J Oatham alleging a breach of Rule 638(1)(d) in that J Riddell (BLUSHING MOSS) allowed his mount to shift out near the 300m when not sufficiently clear of AMARONE which was forced outwards crowding BANG onto ALL THE DRAMA which was checked.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Riddell confirmed to the Committee that he admitted the breach and did not require the Rule to be read out.
Mr Williamson explained the incident using the available films. Mr Riddell was racing in a position adjacent to the running rail in behind the leaders. AMARONE ridden by Ms S Collett was back and following him. Mr Riddell proceeded to roll outwards, approximately two horse widths, forcing AMARONE out into BANG who then moved out onto ALL IN DRAMA which was checked. The Stewards said ALL IN DRAMA was weakening and this had an impact on the severity of the check making it look worse. Mr Williamson said Mr Riddell had not angled his mount out but rather had allowed it to drift outwards as he was following the mount of Mr Hills in front of him.
Mr Riddell said he was battling on the fence and was merely following Mr Hills. It was unfortunate that the other horses were coming around him as he moved outwards.
Submissions for Penalty:
In relation to penalty Mr Oatham produced Mr Riddell’s riding record which showed two careless riding charges over the previous 12 month period. Mr Riddell was suspended for three days on November 28th 2015 and for three days on February 5th 2016. Mr Oatham considered this to be a reasonably good record.
In relation to the degree of carelessness and the consequences Mr Oatham submitted today’s incident sat at the lower end of the scale. He said the fact that ALL IN DRAMA was weakening at the time it was checked made the interference look worse. This was confirmed to him by the rider of ALL IN DRAMA, Ms D Johnson.
Mr Riddell was invited to present penalty submissions. He told the committee he agreed with Mr Oatham’s assessment that the breach was at the low level of carelessness. BANG, one of the horses affected, went on to win the race. He said he considered himself to have a very clean record and he was a North Island rider.
The Committee requested Mr Riddell’s recent riding history outside of the Central Districts. After looking up the records Mr Williamson said Mr Riddell had ridden at Taupo on August 19th and at Ellerslie in March over the Auckland Cup carnival.
Reasons for Penalty:
The Committee first considered the appropriate quantum of penalty to be imposed. Suspension of a riders race day licence is the usual outcome following a charge of careless riding. The Penalty Guide for Judicial Committees recommends a 5 day starting point and from that we consider aggravating and mitigating factors.
We looked at Mr Riddell’s degree of carelessness in today’s incident. Mr Riddell did not push his way through a gap, or angle his mount out seeking clear running, but instead followed the runner in front of him as it moved outwards. Mr Riddell said he was not even aware he had caused interference until the race was over. Mr Riddell’s outward movement did however affect three horses with ALL IN DRAMA receiving a substantial check. Evidence was given that that horse was weakening but nonetheless there still remains a safety aspect with any interference that occurs during a race. In our opinion the degree of carelessness displayed by Mr Riddell sat in the low/mid-range and did not warrant any uplift in penalty.
Mitigating factors were Mr Riddell’s admission of the breach and his good riding record for which we allowed a one day discount. The Committee determined that a four day suspension was an appropriate penalty.
We then had to consider where those days would fall. Referring again to the Penalty Guide for Judicial Committees, under Calculation of days, the guide states:
When calculating the meetings to be included in a suspension judicial committees must use inquiries of the rider and stipendiary stewards and the rider’s recent riding history to ensure the period of suspension is genuine.
The Parkes appeal from 31 August 2015 is clear in its explanation of what makes a penalty “genuine” and says judicial committees must determine where a jockey habitually rides. The only way to do so is to look at their recent riding history. In part it states: “a suspension cannot be considered “genuine” if the period includes a day or days at places where a jockey would not ride and has not ridden except on rare occasions.”
The Steward’s provided evidence of Mr Riddell riding recently in the North at Taupo on August 19th 2016 and at Ellerslie in March. Mr Riddell told us he was a Northern rider but did not go further with his statement. We were not satisfied that Mr Riddell has a recent riding history throughout the Northern region apart from Taupo which has been included in the penalty.
