As Miss Gatu admitted the breach the charge was found to be proved.
Penalty:
Miss Gatu’s Apprentice Jockeys Licence was suspended from the end of racing on 27 October 2012 up to and including racing on 3 November 2012 (four days).
The days being: Counties, Wanganui, Tauranga and Waipa.
Charge:
Following the running of Race 1 information A3041 was filed by Stipendiary Steward Mr N Goodwin under Rule 638(1)(d). The information stated that Miss Gatu permitted her mount “Eveready” to shift inwards when not sufficiently clear of “Rockweiler” which was crowded and checked near the 1000m.
Facts:
Head and side-on films were shown. Mr Oatham said that initially Miss Gatu’s mount shifted away from the runner to her outside, but from then on she allowed her mount to shift in onto Rockweiler for some distance and that finally Rockweiler was checked. He added that she had adequate room and time to shift her mount out off Rockweiler.
Miss Gatu agreed with the Stipendiary Steward’s evidence and added that she should have shifted when the space to do so became available.
Mrs Zimmerman concurred that Miss Gatu should have shifted out and given the inside horse more room.
Submissions for Penalty:
Mr Goodwin said that Miss Gatu had an excellent record, that the carelessness was in the low to mid-range and submitted that a term of suspension was the appropriate penalty.
Miss Gatu confirmed that she had had a total of 45 race rides in Sweden and New Zealand and that she had not previously been charged with careless riding. Mrs Zimmerman agreed that a suspension was appropriate.
Reasons for Penalty:
Judicial Committees have a starting point of 5 riding days suspension. The committee took into account Miss Gatu’s excellent record, her limited number of race rides and the admittance of the breach. The committee placed the carelessness no less than mid-range and under normal circumstances would have imposed a 5 day suspension. Due to the mitigating factors on this occasion they were prepared to reduce that to a 4 day suspension.
