Following the running of Race 5 Mr C.Parish was charged with a breach of Rule 530 (2) (b).
Following the running of Race 5 Mr C.Parish was charged with a breach of Rule 530 (2) (b). The information alleged that C.Parish used the whip in an unnecessary manner when his mount was out of contention.
--Mr Parish admitted the breach and was represented by Mr.Peterson.
--Mr Goodwin demonstrated on the video Mr Parish riding near the tail of the field and well out of contention in the home straight. Despite having no hope of gaining a placing Mr Parish continued to use the whip to the line and according to Mr Goodwin he overstepped the mark.
--Mr Parish had a charge under the same rule on 12/9/07 however Mr Goodwin explained to the committee that the situation then was for excessive use of the whip. Rule 530 (2) (b) reads:
--Every rider commits a breach of these Rules who, in the opinion of a Judicial Committee:
--(b) strikes his horse with a whip in a manner or to an extent which is unnecessary, excessive, or improper.
--Mr Goodwin emphasized that today’s charge was not excessive but rather unnecessary use and therefore was slightly different He added that the breach was not at the top end of the scale and that a fine would be an appropriate penalty.
--Mr Parish and Mr Peterson agreed with all that Mr Goodwin had said, Mr Peterson explaining that Mr Parish was not inexperienced and did know better. As soon as they viewed the film after the race Mr Parish admitted the breach of the rule.
--Penalty Decision
--The committee took all of the submissions into account particularly Mr Parish’s frank admission of the breach and his acceptance of the circumstances.
--He was fined the sum of $500.00.
