In these circumstanced the protest was dismissed. Judges placings stand.

Facts:

Mr Wenn alleged that “Storm Rider” placed first by the Judge interfered with the chances of “Son Of Zoff” (second), the interference occurring in the final straight.

The official margin between first and second was half a head.

Judge’s placings were:

1st – Storm Rider
2nd – Son Of Zoff
3rd – Kings Deep
4th – Speed Up

Submissions for Decision:

Mr Wenn stated that Storm Rider shifted Son Of Zoff inwards a number of horse widths and that he was in front a stride past the post and that he would have won if he had not suffered interference as he was only beaten by half a head.

Mr Manning the trainer of Son Of Zoff said that his horse had come from the back, was shifted in by Storm Rider for some distance and with the margin being a half head said that his horse would have won with a clear run.

Mr MacNab said that his mount (Storm Rider) did shift in two to three widths but that he did straighten it and that no contact was made.

Mr Harrison (representing the Myers stable) said that Storm Rider did shift in approximately two mown strips but that the rider did correct his line as soon as he could and that Mr Wenn did not stop riding at any stage.

Mr Oatham was invited to comment and said that at the 150m mark Mr MacNab’s mount began to shift ground inwards under pressure and as a consequence took Mr Wenn’s mount in approximately three horse widths. He added that Mr Wenn did not stop riding, that both horses finished strongly to the line and asked the committee to take into account the half head margin.

Reasons for Decision:

The committee found that near the 150m mark Storm Rider began to shift in under pressure and dictated Son Of Zoff inwards over a distance of approximately three horse widths. During the inwards movement it was observed that Mr Wenn the rider of Son Of Zoff was able to continue riding out fully with the whip. As both horses finished strongly to the end of the race and that the committee believed that Son Of Zoff did not lose momentum, the committee was not satisfied that Son Of Zoff would have beaten Storm Rider if interference had not occurred.
