Decision:

Following the running of Race 6, Mr P. Bell was charged with a breach of Rule 849 (3). The information alleged that P. Bell being the rider of USE TO BE A DANCER did add an article of riding gear after weighing out.



Following the running of Race 6, Mr P. Bell was charged with a breach of Rule 849 (3). The information alleged that P. Bell being the rider of USE TO BE A DANCER did add an article of riding gear after weighing out.

Mr Bell admitted the breach and was assisted by Mr G. Searle.

Mr George was asked to outline the facts and make submissions on penalty. He told the committee that as Mr Bell weighed out prior to Race 6 he advised the Clerk of the Scales that he had a girth cover. Upon returning to the jockeys' room he realised that the girth cover had not been presented with the gear. Mr Bell took the girth cover to the tie-up stalls and passed it to the trainer to add to his gear. He was observed doing this by the Racecourse Inspector Mr B. Bevage.

Mr George described the incident as simply an oversight by Mr Bell and requested a monetary penalty of between $100 and $300.

Mr Searle told the committee that this was the first time this had happened and agreed with Mr George that it was an oversight by Mr Bell rather than a deliberate action.

Penalty

In coming to a decision on penalty the committee accepted that Mr Bell's actions were not deliberate however he must understand that it is not acceptable to add gear once a jockey has weighed out. It is the rider's responsibility to ensure that they weigh out with the correct gear each time they present at the scales. For not doing so Mr Bell was fined the sum of $200.
