Following the running of Race 6, The Group 3 Highview Stud Stakes, Mr B.R.Jones was charged with careless riding under rule 871 (1) (d)



Following the running of Race 6, The Group 3 Highview Stud Stakes, Mr B.R.Jones was charged with careless riding under rule 871 (1) (d). The information alleged that B.R.Jones being the rider of Special Mission permitted his mount to shift inwards when not sufficiently clear of Stravinskys Affair (D.Walker) who was checked and forced inwards onto Royal Taat (L.Cropp) with Emily Jane (B.Herd) Insouciant (M.Walker) and Diamond Deck (M.Coleman) all hampered as a result.

Mr Jones did not admit the breach.

Mr.George called on Mr.Goodwin to outline the alleged incident by way of video. He identified all of the horses involved and showed that towards the end of the back straight Mr Jones shifted in, when not the required distance clear of Stavinskys Affair, causing Mr Walker to restrain his mount. As a result Mr Walker was moved inwards where he made contact with Royal Taat which caused tightening and pressure to horses behind.

The side-on view showed Mr Walker checking his mount which Mr Goodwin alleged was the result of Mr Jones crossing in front of him when not clear.

Mr George called Mr David Walker, the rider of Stravinskys Affair, to give evidence. Mr Walker told the committee that approximately 150metres after the start he was sitting one off the fence when Mr Jones angled his mount inwards when only about three quarters of a length clear of him. He continued to move inwards and Mr Walker was forced to restrain his mount which took him into contact with Ms Cropp's horse. Mr Walker said that his horse was racing tractably prior to the interference occurring.

Mr George stated that Mr Walker was maintaining a straight line until such a time that Mr Jones moved inwards and took his line when only a length clear at best.

Mr Jones called Ms Cropp as a witness and, in reply to questions from Mr Jones, she stated that her mount was racing quite tentatively and indecisively in beside the fence. She maintained that her horse was watching the running rail and lost ground as a result of its demeanor rather than interference.

Mr Jones wanted to call Mr Mark Walker (trainer of Special Mission) at a witness however despite numerous attempts Mr Walker was unable to be located. Mr Jones explained to the committee that he wanted Mr Walker to give evidence as to the wayward racing manners of Special Mission. The Stipendiary Stewards accepted this evidence and Mr Jones was satisfied that Mr Walker was not required in person.

Mr Jones explained that in this situation Special Mission may have rolled inwards a fraction of her own accord as she has been known to do.

He also told the committee that, in his opinion, Mr Walker checked his mount because it was over-racing with its head in the air and he was anticipating a movement that did not eventuate. He said he was always the required distance clear and that the films were not conclusive in proving that he was guilty of careless riding.

Decision

--

The committee had careful regard to all of the submissions put before it. It was our view having considered the films at length and taking into account the evidence, particularly that of Mr David Walker, that Mr Jones did move inwards and take the line of running of Stravinskys Affair. This caused a domino effect onto other runners on the inside and behind. The side on video showed that Mr Jones was probably only one length clear, not the required two lengths, when he crossed. The committee did not accept that the video evidence was inconclusive and subsequently found the charge of careless riding proved.

Penalty

--

Mr George's submissions to the committee included producing Mr Jones's riding record which showed previous charges of careless riding on 7/4/07 and 26/12/06.

--

He said that today's circumstances warranted a suspension in the vicinity of three to five days with an additional monetary penalty.

--

Mr Jones made submissions citing his good riding record and telling the committee that he rides in both the North and the Central Districts with engagements for Wednesday at Te Aroha.

--

In coming to a decision on penalty the committee considered all of the submissions put before it.

--

Mr Jones's riding record was considered to be very good however there were a number of horses affected by this incident of careless riding. The committee also had regard to the stake and Group 3 status of the race.

--

It was the opinion of the committee that the penalty imposed warranted a term of suspension and after considering all factors we determined that five days and a fine of $500 be imposed.

--

In determining when the suspension should start Mr Jones made it clear that he had riding engagements for Wednesday therefore the committee believed that he should fulfill these engagements.

--

Mr Jones is suspended from riding from the conclusion of racing on Wednesday 26th September until the conclusion of racing on Friday 5th October. In addition there is a fine of $500.00.
