Decision:

Following the running of Race 9, the Wassco Dog Trailers 1600, Mr S Doyle lodged a protest under Rule 876 (1) alleging that Cape Fear or its rider placed 1st by the judge caused interference to Russian Jack placed 2nd by the judge.  The interference occurred in the home straight.

The margin between first and second was half a head.

The information was filed with the registrar within the time prescribed and an announcement was made over the course PA system to notify the connections of the horses involved.  Russian Jack was represented by Mr S Doyle and trainer Mr S Barlow while Cape Fear’s connections were Mr G Andrew (for M and P Moroney) and rider Mr T Sasada.

Mr Doyle used the head and side-on films to identify the horses involved and outline the incident that he was concerned about.  He said that Mr Sasada was making a run down his outside on Cape Fear when that horse moved inwards getting close enough to prevent Mr Doyle from using the whip and then making contact which put his mount, Russian Jack, off stride.

Mr Barlow said that the contact between the horses forced Russian Jack to change ground which put him off stride and that he should have won the race.

Mr Sasada admitted that Cape Fear had moved inwards and made contact with Russian Jack but stated he had immediately straightened his horse.  The little interference that occurred did not cause Mr Doyle to stop riding.  Mr Sasada said that his horse was traveling much better and with or without interference he was always going to beat Mr Doyle’s mount.

Mr Andrew said that Mr Doyle did not stop riding at all and that Cape Fear always had him covered.

Mr Goodwin, for the Stipendiary Stewards, said that Cape Fear had come from behind Russian Jack and in his opinion the interference did not affect the chances of Mr Doyle finishing in a higher placing.

Decision

Rule 876 (1) states:

--

 

--

 If a placed horse or its Rider causes interference within the meaning of this Rule 876 to another placed horse, and the Judicial Committee is of the opinion that the horse interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with.

--

After listening to all the evidence and viewing the films the committee accepts that some interference occurred when Mr Sasada’s mount moved inwards and made contact with Russian Jack.  It was our opinion that the bump was slight and despite Mr Doyle momentarily being unable to draw his whip we did not believe that it cost him the chance of winning the race.

Cape Fear came from a position behind Russian Jack, was finishing strongly and won by a half head margin.

Taking into account all of these factors the protest was dismissed and placings allowed to stand as called by the judge.
