The Charge of Careless Riding preferred against Mr Lammas was found to be proved.

Mr Lammas’ Jockey’s Licence was suspended from the close of racing on 25 September up to and including racing on 9 October 2019 (9 Riding Days).
Facts:
Following the running of Race 8 (Windsor Park Plate) Information No. A11652 was filed with the Judicial Committee. It was alleged by the Informant that Mr Lammas allowed his mount HELLO IT’S ME to shift inwards shortly after the start when not clear, crowding SULTAN OF SWING and DARK PRINCESS.
Mr Lammas said that he understood the Rule, the Charge and confirmed that he did not admit the breach. Mr Lammas was advised by the Committee of his rights during a defended hearing.
Submissions for Decision:
Stipendiary Steward Mr Goodwin identified all 3 horses on the film replays. He then said that Mr Lammas could be seen to look in and then shifted his horse in towards Mr Weatherley’s mount (SULTAN OF SWING) who went in onto DARK PRINCESS (L Allpress). Mr Goodwin said that you could see that Mr Weatherley’s body turns in when he tried to get away from Mr Lammas’ mount. He estimated that HELLO IT’S ME was approximately 1 to 1 ¼ lengths clear when being shifted in.
Mr Lammas asked Mr Goodwin if it looked like he had full control of his mount as its mouth was open. Mr Goodwin said that he could not answer that, but added that you (Mr Lammas) had looked, then went in and tightened the inside horses and then shifted out, but that that was after the interference.
Mrs Allpress the Rider of DARK PRINCESS said that she got interference from the outside and hit the running rail. In answering a question from Mr Utikere as to what she observed on her outside, Mrs Allpress said that she called to Mr Weatherley, who was trying to relieve the pressure.
Mr Lammas did not have any questions of Mrs Allpress.
Mr Weatherley the Rider of SULTAN OF SWING, said that he had Mrs Allpress on his inside and that he got a little bit of pressure from his outside. He said that it is a difficult corner and that he was in a tricky situation. He said that he tried to get off the heels from the horse on his outside (HELLO IT’S ME) who was 1 ½ lengths clear of his horse. He added that Mrs Allpress was calling before the interference and that Mr Lammas came across when not quite clear of him.
Mr Lammas asked Mr Weatherley if the pace had slackened off. Mr Weatherley responded by saying that he had to look after Mrs Allpress and get away from heels and said that it was a difficult corner.
Mr Lammas for his part told the Committee that when his horse jumped (from the barrier) it had its mouth wide open, that he came in off MELODY BELLE’s heels and that his horse hung in. He said that it was only for a split second and one stride. He said that he could not react that quickly and that he did come out off the inside horse. Mr Lammas said that his mount hung all the way, and that it was inconclusive as to what had happened, due to the lack of a head-on film, and that you could not see where he was trying to steer his mount.
Mr Oatham said that it is a difficult corner. He said however that Mr Lammas did not exercise due care. He said that it was a lack of care when he directed his horse inside Mr Bosson’s mount's heels (MELODY BELLE). He said that the crux of the charge was a lack of judgement. He said that Mr Lammas’ mount may well have raced unkindly, but that he did not allow sufficient room for two horses on his inside. Mr Oatham added that the films showed that Mr Lammas was nowhere near 2 lengths clear and was only 1 ¼ lengths clear, and that there was severe crowding, with Mrs Allpress put in a precarious position.
Mr Lammas said that he got up on MELODY BELLE’s heels and that if he went out, he would have probably fallen. He said that he was clipping heels, that his mount’s mouth was wide open, and that he tried to steady and come back out.
Reasons for Decision:
After giving due consideration to all of the evidence plus revisiting the film replays, the Committee found that in the run around the first turn, Mr Lammas allowed his mount HELLO IT’S ME to shift into the rightful running line of SULTAN OF SWING when not sufficiently clear. As a consequence of the shift, SULTAN OF SWING was taken inwards onto DARK PRINCESS who became very tight and hit the running rail. It was noted that whilst Mr Lammas’ mount may have been an awkward ride, Mr Lammas failed to demonstrate adequate care to prevent interference occurring to runners on his inside. Mr Lammas did shift his mount outwards but this was subsequent to the interference occurring. The evidence of Riders Mrs L Allpress and Mr S Weatherley was not contested by Mr Lammas.
Submissions for Penalty:
Mr Oatham said that Mr Lammas had a very good record with only two previous breaches of the Rule in the last 12 months. He placed the carelessness in the mid-range category and suggested that the Committee take into account that the interference occurred in a Group 1 Race with a significant stake.
Mr Lammas initially asked for any suspension imposed to start after racing on 22 September, but subsequently requested that it start after 25 September.
Reasons for Penalty:
The Committee placed the careless riding exhibited by Mr Lammas as no less than mid-range. The penalty starting point for such a breach is one of 8 riding days suspension.
The Committee adopted the starting point and increased this by 2 days due to the carelessness being in a Group 1 Race with total prize money being $200,000.
On account of Mr Lammas’ very good record a discount of one riding day was considered appropriate. The Committee was mindful of the racing manners of HELLO IT’S ME when assessing quantum of penalty.
