Decision:

Following the running of Race 4 Ms. J. McGuiness was charged with careless riding under Rule 638 (1) (d). The information alleged that near the 150 metres J. McGuiness (STRAVINSKY’S AFFAIR) allowed her mount to shift out when insufficiently clear of TRISTAN’S CHOICE (B. Lammas) who was severely hampered.

Following the running of Race 4 Ms. J. McGuiness was charged with careless riding under Rule 638 (1) (d). The information alleged that near the 150 metres J. McGuiness (STRAVINSKY’S AFFAIR) allowed her mount to shift out when insufficiently clear of TRISTAN’S CHOICE (B. Lammas) who was severely hampered.

Ms McGuiness admitted the breach and was represented by trainer Mr. Kevin Gray.
 
Mr. Goodwin showed the head-on view of the final stages of the race where STRAVINSKY’S AFFAIR began to drift out across the track when under pressure. Ms McGuiness did not do enough to straighten her horse and Mr. Lammas who was racing in behind was forced to stop riding for several strides. He then had to change ground and angle his mount to the inside of Ms McGuiness to gain clear racing room.  The side-on video demonstrated the extent of the interference that Mr. Lammas suffered.

In his submissions on penalty Mr. Goodwin said that Ms McGuiness was an inexperienced rider who, on this occasion, got excited when she realized she had a chance of winning the race. He said that despite having 100 rides she had never been charged with any breach of the rules. He suggested that the interference was in the mid-range and a suspension was the appropriate penalty.

Mr. Gray asked the committee for some leniency due to the racing manners of the horse. He said she had a history of running about in her races and was wearing a one-eyed blinker to encourage her to run straight.

Ms McGuiness accepted that she had moved outwards and could have done more to straighten her mount.

Decision
In coming to a decision on penalty the committee took into account Ms McGuiness’s admission of the breach, her excellent riding record and her relative inexperience. We also considered the racing manners of STRAVINSKY’s AFFAIR.

Despite these mitigating factors we have to take into account the degree of interference that occurred as a result of Ms McGuiness’s carelessness. Mr. Lammas was sufficiently hampered to consider lodging a protest and was only dissuaded after learning of the margins (11/4 lengths).  We would expect that despite her inexperience, for Ms McGuiness to display a higher degree of care.

Ms McGuiness is suspended from the conclusion of racing today, Saturday November 21st, until the conclusion of racing on Wednesday December 2nd. The committee considers this to be a four day suspension taking into account that Ms McGuiness is a North Island rider and has no confirmed rides in the next seven days.
