As the breach was admitted we find the charge proved.

Penalty:

Accordingly after considering all the above facts we impose a suspension of Miss Myers' license to ride in races which is to start after racing on 28 April and conclude after racing on 2 May 2012 (4 days).

Facts:

Following race 1 an information was filed pursuant to rule 638(1) (d).  The informant Mr N Goodwin alleged that over the concluding stages Miss Myers allowed her mount LA SOMMELIERE to shift in causing CATALAN KING to check.

Submissions for Decision:

Mr George demonstrated the video films which showed LA SOMMELIERE racing in a position 2 from the outside approaching the 100 metre mark.  He pointed out to the committee Miss R Myers shifting in approximately 1 horse width and into the line of CATALAN KING (Mr J Collett) when only a bare length clear.  Mr George said Mr Collett had to stop riding and check his mount. 

Miss Myers in admitting the breach said her mount overreacted to the whip and felt that if Mr Collett's mount had been going well enough the interference may not have occurred.

Submissions for Penalty:

Mr Goodwin said Miss Myers had an excellent record with only 2 suspensions in the last 12 months.  He submitted a 5 day suspension would be appropriate. 

Miss Myers said she rode throughout the country and had commitments up to and including 28 April.

Reasons for Penalty:

The committee carefully considered all submissions and evidence.  In mitigation Miss Myers has admitted the breach and has a very good record.  However she was clearly in breach of the rule by moving in when not the required distance clear.  However the committee finds her carelessness to be at the low end of the scale.  From a starting point of 5 days and because of the mitigating factors above we find the appropriate penalty to be one of 4 days suspension.
