Accordingly we were satisfied that KAPSBOY and TYNE COT were denied fair starts due to mechanical failure of the starting gates and pursuant to Rule 632 the Judicial Committee declared both horses to be non-starters.

Facts:

Following the running of Race 7, the Stella Artois Sprint, Mr Neal lodged an information requesting a ruling in relation to Rule 632 to determine whether KAPSBOY and TYNE COT were denied a fair start.

Rule 632 reads: If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a Race owing to mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away by its own accord), the Judicial Committee may declare such horse to be a non-starter.

Submissions for Decision:

Using the head-on film Mr Oatham identified the runners involved, with KAPSBOY (Ms Holmquist) starting from barrier 12 and TYNE COT (Mr Tinsley) from barrier 13. The start of the race was played multiple times, frame by frame, and evidence was heard from both riders. Mr Tinsley told the committee his horse was playing up in the gates and as a result he had an attendant up with him. He had an inkling that his gate was slow to open but at the time he couldn’t be sure. Ms Holmquist said her horse charged the front of the gate because it was slow to open. The Stewards sounded the siren soon after the race when they noticed on the video that there had been a problem with the start. Mr Oatham paused the film showing the two outside gates wide open but the gates of TYNE COT and KAPSBOY remaining closed. It was also suggested that there may have been a slight variance with some of the centre gates as well, but not to the extent of the two affected horses. The side on film showed Mr Tinsley and Ms Holmquist at the rear of the field soon after the start, highlighting the amount of ground both horses lost.

The Committee also heard evidence from the respective trainers as to the normal racing patterns of both horses.

Mr Neal said while there may have been a marginal disparity between some of the gates opening the two most affected were KAPSBOY and TYNE COT.

Reasons for Decision:

The Judicial Committee carefully considered all of the submissions. The side-on film showed TYNE COT lost 2 – 3 lengths at the start and KAPSBOY was back with it. KAPSBOY who normally races in a forward position today finished last. TYNE COT finished in 6th place. It was our opinion that both horses had their chances materially prejudiced. The head-on film confirmed that the gates of both horses were slow to open and the tardy start was no fault of either runner.
