An information alleging a breach of Rule 530 (2) (b) was filed alleging the rider of MINNALOUSHTRI Jockey Peter Cunningham used his whip in an excessive manner on a horse out of contention.

--The breach of the rule was admitted.
--Stipendiary Steward Mr Neal, using the available films, informed the committee Mr Cunningham’s horse was three wide approaching the home bend. It was, he believed, a spent force and was racing in last position. He strongly believed the horse was struck in an excessive manner. On speaking to Mr Cunningham he was told that the instructions on being legged up by a stable representative was to “bash it”. This was Mr Cunningham’s first charge under this rule and Mr Neal asked for a monetary penalty of between $200 and $300.
--Mr Cunningham confirmed Mr Neal’s statement and told the committee that in hindsight and upon viewing the films his actions on the mount were not good. He was apologetic and agreed with the chairman that it was not a good look for racing. As a high weight and jumps jockey it was his first ride back in what he hopes will be a busy season.
--DECISION AND REASON
Mr Cunningham was advised that in coming to its decision to impose a monetary penalty the committee took into account that this was his first breach under this rule, and that headmitted the breach.
The committee was impressed by his forthright manner, his concession that his actions did not look good, and that was reflected in a small reduction in his monetary penalty from the maximum figure that Mr Neal asked for. Incidents like this do not look good and we believe the comment from the stable representative to “bash it” was not in the best interests of racing. It was something that an experienced jockey like Mr Cunningham should have disregarded. Mr Cunningham was fined the sum of $250.00.
