As Mr Lammas admitted the breach we found the charge proved.

Penalty:

Mr Lammas is suspended from the close of racing today, September 2nd , up to and including racing on Friday September 22nd. (Mr Lammas advised that he only rides regularly within the North Island). This equates to a period of 10 North Island race days.

Facts:

Following the running of Race 7(Tarzino Trophy Group 1), an Information was lodged by Mr J Oatham alleging a breach of Rule 638(1) (d) in that Cameron Lammas (UNDERTHEMOONLIGHT) angled his mount out near the 400metres when not clear of AUTHENTIC PADDY (L Innes) which was checked and clipped a heel and GINGERNUTS (O Bosson) which was checked.

Rule 638(1)(d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Lammas confirmed to the Committee that he understood the charge and that he admitted the breach.

Mr Oatham asked Mr Goodwin to show the incident using the four different camera angles available. Approaching the 400m Mr Lammas angled his mount outwards to improve from a midfield position. In doing so he placed Mr Innes in restricted room causing his mount AUTHENTIC PADDY to blunder. Mr Lammas carried on outwards and caused a check to Mr Bosson on GINGERNUTS. Mr Goodwin estimated that Mr Lammas moved outwards approximately 3-4 horse widths from his original position three off the rail.

Mr Lammas told the Committee that there was a lot of interference ahead of him and to his inside which forced him to angle outwards. He said RANGIPO (V Colgan) stopped very sharply and in order to avoid the heels of horses in front he had no option but to move outwards. He said he was forced to take the action he did.

Submissions for Penalty:

Mr Oatham produced Mr Lammas’ record which showed four careless riding charges over the last 12 months:
17/9/16 - 6 days
12/10/16 - 4 days
1/1/17 - 4 days
18/3/17 - 18 days

He said today’s breach was relatively high-end resulting in severe interference to two runners in a Group 1 race. Mr Oatham said Mr Lammas shifted deliberately outwards over quite some distance and the Stewards’ submission was for a three week suspension.

Mr Lammas reiterated that he had no option but to move outwards like he did. He said he did look briefly before moving out but Mr Innes was roughly ¾ of a length behind him in his blind spot. He said his horse was travelling “too good” and he believed Mr Innes was a little bit unlucky to clip a heel.

Mr Lammas advised that he had no confirmed riding commitments within the next seven days so any suspension could start straight away.

Reasons for Penalty:

The Committee adopted a five day starting point for careless riding charges as outlined in the Penalty Guide for Judicial Committees. We adjusted the starting point upwards to 10 days to reflect both Mr Lammas’ degree of carelessness and the repercussions it caused. Mr Lammas believed that, due to interference ahead of him, he had no option but to move outwards. While it was true that Mr Lammas had nowhere to go the rules do not allow him to force a run if he is not clear to do so. As a result of Mr Lammas’ actions AUTHENTIC PADDY clipped a heel and by continuing on an outward movement GINGERNUTS was also badly checked. The breach, in our opinion, was towards the upper end of careless riding.

The Group 1 status of the race and the stake of $200,000 were aggravating factors for which we added another day.

Mr Lammas’ record shows four careless riding charges over 12 months but we have had regard to the fact that he is a busy rider and his last suspension was five months ago. We have therefore considered his record a neutral factor.

The only mitigating factor was Mr Lammas’ admission of the breach for which we have afforded him a one day discount.
